The ‘Daily Show’ defense against open records?

shhhh4The Obama administration is supporting a goofy legal claim previously put forward by the Bush administration that it shouldn’t have to release statements that Dick Cheney made to a special prosecutor about outed spy Valerie Plame because it could become fodder for “The Daily Show.” Even the judge hearing the open records lawsuit couldn’t believe it.

    “U.S. District Judge Emmet G. Sullivan expressed surprise during a hearing here that the Justice Department, in asserting that Cheney’s voluntary statements to U.S. Attorney Patrick J. Fitzgerald were exempt from disclosure, relied on legal claims put forward last October by a Bush administration political appointee, Stephen Bradbury. The department asserted then that the disclosure would make presidents and vice presidents reluctant to cooperate voluntarily with future criminal investigations.

    But career civil division lawyer Jeffrey M. Smith, responding to Sullivan’s questions, said Bradbury’s arguments against the disclosure were supported by the department’s current leadership. He told the judge that if Cheney’s remarks were published, then a future vice president asked to provide candid information during a criminal probe might refuse to do so out of concern “that it’s going to get on ‘The Daily Show’ ” or somehow be used as a political weapon.”

    Cheney must’ve made some stupid and embarrassing remarks to trigger the ‘Daily Show Defense’.
    An admin. would be uncooperative with an investigation, who’s ever heard of such a thing?

    Who cares, it was well known that Valerie Plame and her husband, flaunted her CIA status around D.C. like some carnival pitchman, hoping for political back scratching.

    Plame deserved what she got for having a big mouth. We don’t need people like that in the CIA with big mouths and loose lips.

    Other then a fifth amendment claim, embarrassment or concealing the actions of another are not a valid excuses. It is not a valid or sound claim that a future Vice President would choose to refuse to answer and as such violate the lawful inquiry because it might become an embarrassment. The President and Vice President are not above the law or the court system. AND Cheney’s answers are a matter for a serious inquiry before they would ever be for a public consumption. If his actions were or were not of a criminal nature then there is were the answers are to be aired. Not to be evidence in a public opinion court.

    Typical leftwing fodder. Obama is trying desperately to change the subject and he needs all of the help he can get. The more pertinent question would be why won’t they release the results of the ‘torture’ interrogations?

    Obama is protecting himself in the future and we certainly know that Biden has ‘loose lips’ so this is probably a good premise to hold on to.

    As Outlander brought out, this specific defense was issued only by the Obama administration.

    The Obama administration’s strategy was to make it look like Cheney deeply embarrased himself and that they are being gentlemenlike by keeping it a secret to prevent “humiliation”. However, in reality, this defense reveals 2 pathetic characteristics about themselves:

    1. The Obama administration actually really cares about what is said by late night morons on comedy tv.

    2. The Obama administration is concerned about what might be said about their own administration (i.e. Biden) if the late night morons had full access to every one of their statements.

    So as always, their strategy is self defeating and makes them look like bigger fools. Ladies and Gentlemen, The highest office in the land is now a tool for late night comedy.

    Pre I guess you did miss something. Obama is defending his own administration not Cheney. He would throw Cheney to the wolfs on a moments notice as he and Pannetta tried to do last week and failed.

    He is using this lame defense to cover his rear only.

    Note to the reflexive right wing poster who routinely imagines a left wing media conspiracy.

    A lot of people watch the Daily Show, however, many of them don’t watch it on television when it airs. Lots of the Daily Show’s viewrship comes on computer via the intertubes.

    And both the Bush and Obama Administration seem to be worried about The Daily Show. In one of my rare agreements with AmWay, this defense is lame no matter which Administration puts it forward.

    Going back to lurking and blog vacation.

    OR could it be that all this including the memos that Cheney wanted released is nothing.
    And would only be some bright and shiny objects that would cause the focus to be on something that is nothing more at this time then a distraction? I have no idea what Cheney said and trust his version of “truth” even less. For all we know the memos could say that an Iraqis bought some sandals from someone in Afghanistan and that is a link to terrorism. It would be in Cheney’s world, but the jury of public opinion is out. You either think that Cheney ordered the disclosure of Planes I.D. or you do not.
    At this point evidence either way would not change your mind no matter which conclusion you have.

    If there was anything in the evidence that is so damning, don’t you think it would have already been used in a criminal trial? The point is that Obama would rather of this not being on his watch and it is something that will fall into one of those least kept secrets to be argued for hundreds of years and nothing done about it.

    The Daily Show, what the heck is that? btw since when does a president and it’s administration base it decisions upon what the people in hollywood might say about him. What kind of leadership is that?! If he can’t stand up to them, who can he stand up to?

    I think we have a president that makes decisions on what others think or may say about him. We need a leader that will make decisions based on what is right for the people of our country and quit worrying about his image. It’s time to grow up and stand up for the people who elected him. And most important he needs to stand up for those who didn’t vote for him too.

    I know that is very hard for some of you to do because you think that he should only support the democrats. Know this: what he does done to one us, he also does to the rest of us. UNITED WE STAND, DIVIDED WE FALL. OBAMA, IT’S TIME TO PULL THIS COUNTRY TOGETHER & QUIT RIPPING US APART.

    Hey, Borghunter; The Daily Show takes place in New York City–not Hollywood. It can be funny; it is political and makes fun of both Repubs & Dems. Once in awhile he is pretty serious about some occurence but for the most part, I think he goes for laughs.

    If you have tender ears when it comes to what George Carlin called the 7 dirty words, you might want to skip the show or have the volume control handy.

    Since you are a borg hunter, did you ever meet up with 7 of 9?
