Franken wins — for now

The state Canvassing Board is expected to declare today that Al Franken received the most votes in Minnesota’s election for a U.S. Senate seat, but those final results are sure to be challenged in the courts. Franken reportedly had a 225-vote lead after last weekend’s count of some absentee ballots.
If Franken’s win holds up, he will become the new senator the right wing loves to hate. That’s because Franken’s confrontational style makes him the “perfect right-wing punching bag,” according to The Week, and because the GOP will consider Franken’s win tainted and illegitimate.

    As I understand it under Minnesota law (just from media reports; I’ve done no research on Minnesota law), a judicial challenge is entirely appropriate. Let Minnesota settle this one, according to Minnesota law.

    Interesting question, however. Will Minnesota have the same equal protection problems found in Florida in 2000? And if so, will one party or the other seek to get the federal courts involved? Only time will tell.

    When it’s over, seat the winner; no whining about “stolen” elections like we’ve heard ad nauseum for the last eight years. And move on.

    As you’d expect, the Journal editorial page is already coming up with a string of bogus insinuations about the Minnesota recount, all suggesting that the process has somehow big rigged in favor of Al Franken or even that there’s some more Republican fantasy voter fraud involved. One point they don’t mention though: the canvassing board, the outfit making all the key decisions has at least as many Republicans as Democrats, and may actually have more Republicans than Democrats. What’s more almost every key decision has been made unanimously.

    Secretary of State Mark Ritchie is an elected Democrat. He serves on the canvassing board automatically. For the rest he picked two Republican state Supreme Court Justices (justices appointed by Gov. Pawlenty (R)), one Independent judge appointed to the bench by former Gov. Jesse Ventura, and a fourth county judge who may be a Democrat or an Independent (we don’t know because it was a non-partisan election).

    Needless to say, the Journal doesn’t mention this, but hints at it in this feeble excuse, claiming that the rest of the canvassing board has been “meek” in the face of Ritchie’s “machinations.”

    Pretty pitiful, but standard fare from the Journal oped page.

    GMC – I agree. It seems that MN has been doing an orderly and transparent count. Hopefully they can get it resolved – one way or the other. Perhaps the big thing is to NOT get a lot of outsiders involved.

    I agree with NOT involving outsiders! It is the state’s business. And they seem to have been doing a good and transparent job of handling it quite well.

    I wish Reid would keep his nose out of Illinois business too. I’m not trying to make any excuses for Blagojevich (there are no excuses!) but until and unless the Illinois legislature relieves him of his duties, everyone else has no business sticking their noses in. And then, even if they do relieve of him of his duties, will it be retroactive? They messed up when they recessed without handling their duties!

    I have many questions, hoping someone knows answers, please.

    If the (Minnesota) state Canvassing Board certifies the final result of the race today, will Franken be among those sworn in tomorrow in DC?

    Further, at one time I heard court challenges that might include unseating a Senator would potentially be more difficult than those merely challenging election results. Is that true? If so, does that mean Coleman has some part of today to file court action, and get a remedy from said court on the election results?

    Add Franken’s 220 vote win, and the 750 alleged initial win coleman claimed, and there was around a thousand votes either not counted, mis-counted, or wrongly rejected.

    Personally, I want to see that man seated, but all legal challenges continue and be transparently resolved–even if that means Coleman prevailing after the fact, and booting a sitting senator. That’s the way the process is supposed to work.

    What happened in 2000 was, of course, far different. By this time eight years ago the Supreme Court had long since cut democracy off at the knees. It was a perfectly legal decision, since they had jurisdiction, but an ethically reprehensible and dangerous one nonetheless.

    Strange things keep happening in Minnesota, where the disputed recount in the Senate race between Norm Coleman and Al Franken may be nearing a dubious outcome. Thanks to the machinations of Democratic Secretary of State Mark Ritchie and a meek state Canvassing Board, Mr. Franken may emerge as an illegitimate victor.

    Mr. Franken started the recount 215 votes behind Senator Coleman, but he now claims a 225-vote lead and suddenly the man who was insisting on “counting every vote” wants to shut the process down. He’s getting help from Mr. Ritchie and his four fellow Canvassing Board members, who have delivered inconsistent rulings and are ignoring glaring problems with the tallies.

    … election officials opened and counted more than 900 absentee ballots that had erroneously been disqualified on Election Day.

    Coleman’s lawyers have argued that some ballots were mishandled and others were wrongly excluded from the recount, giving Franken an unfair advantage. After a Minnesota Supreme Court decision went against Coleman earlier Monday, lead attorney Fritz Knaak said a lawsuit was inevitable.

    Only because your preferred candidate lost. Were Coleman ahead, you’d be crying again. The left’s constant protesting of Bush v. Gore was, and is, based almost entirely on result, not on principle.

    LOL after reading part of one of his books I would say that Franken finds the right-wing the prefect punching bag! His high brow humor may leave some at a lost on the Republican side. Unlike many whom take a swing at the left. He can counter with more then the likes of “Oh yeah I know you are but what am I?”. It should be interesting to see Franken and Boehner going at each other. Maybe it would bring out some of our brightest too.

    Frequently on here I have said that we hire men off the street with no training and our starting wage is $9.50 an hour. This doesn’t fit your stereotype does it. Those mean old cons.

    It seems that the democrats are afraid of a legal battle. They can manipulate the recount but they can lose under the rules of evidence in court. Under Minnesota law, an election certificate does not issue until litigation has been concluded.

    On a lighter note, Burris will show up at the Senate tomorrow and face the democrats and expect to be seated.

    It’s going to be very hard for SNL to make this funnier than it already is!

    Two thing for the record, one is I have met and had a very nice conversation with OKie/Granny she is not a Trump and works hard to make a business run they are working owner. Two if someone does not hire these convicted felons just what do you think they can do? If they do not have a job more often then not it is back to lock-up. Or after awhile they are on the streets with nothing else to do and out of money. Pretty soon the old criminal ideology kicks in, “why should I work forty hours a week, doing something I hate for someone I can not stand. When in five minutes I can make as much as I would working forty hours a week?”.

    Few employers hire ex-con or work releases no matter how little they would have to pay them.

    As to Bluejay, a coward is not an adjective I ever use to describe him. At worst and no offense BJ I would describe him like a Banty Rooster. Not the biggest Rooster in the yard but will not back down no matter what the size of the animal he is facing. Aggressive in his stance and attack and shocking at his intensity.
    I had one go after me every time I would enter the chicken yard, it shocked and amazed me that such a small bird would attack me. Never backing down and would place himself in the way of a fight.

    I’d think a court would be very reluctant to overturn the findings of the re-count. Coleman already was ruled against by one court.

    Franken Declared the Winner in Minnesota

    The Minnesota canvassing board has declared Democrat Al Franken the winner of the hotly contested Senate race there. Sen. Norm Coleman (R-MN) filed a suit with the state Supreme Court but the court threw it out yesterday. Coleman vowed to contest the election with another suit, but the chances of him prevailing in the state courts are slim. Even if he gets most of what he is asking for, that is unlikely to produce enough votes to overturn Franken’s margin.

    The suit will claim that since each county counted and recounted its own votes without statewide guidance, different standards were used in different counties, thus violating the constitution’s equal protection requirement. Of course, lack of statewide standards applies to all state and federal elections in all states, so that is hardly unique to this case. Thus it seems that his real game plan is to appeal to the U.S. Supreme Court and get a 5-4 decision in his favor as in the Florida 2000 election. Only then, the Supreme Court stopped the counting. Now the counting is finished. It is not clear what the court could decide–maybe force a recount of the entire state?

    Harry Reid has backed his own dumbbutt into a corner on this one. He tried to be too clever by half regarding Burris, and he’s shot himself in the foot regarding Franken.

    What a nitwit. PLEASE Harry, go “spend more time with your family”.

    Of course, that’s what a lot of the country thinks of pasty roberts too.

    Now that would be deliciously ironic, since it would be exact opposite of what was ordered in Bush v. Gore! But, hey, they made a point of saying it should not be treated as a precedent (which is weird as it sounds). It would fascinating to see how the Supremes would be deal with the equal protection issue when it actually involves counting votes.

    As I did in 2000, I want democracy to prevail today, no matter how badly GMC wants to pretend otherwise. I’m not sure how big an issue equal protection is in Minnesota, but we might find out soon enough.

    GMC is right on one thing when it comes to Republicans, expect situational ethics. (Depends on who’s in the situation at hand)
