Good news for Sedgwick County District Attorney Nola Foulston: After a promising start, Republican Mark Schoenhofer’s aggressive challenge looks to be stuck in the ’30s, judging from Survey USA polling for KWCH, Channel 12. In a weekend poll of 800 adults, Foulston led Schoenhofer 55 to 38 percent, compared with 54 to 39 percent a month ago and 51 to 45 percent in August.

I had the chance to meet DA Foulston when I took my mom to the Senior Expo.
She is a very pleasant, friendly, and informative.
I wish there was a real alternative to vote for. This cycle there is not.
My thoughts exactly, Steven. The ONLY choice is not cast a vote in this race or vote to reelect Foulston. Maybe the Republican Party can find someone other than a kooky crook to put on the ballot next time. Probably not, tho, since their goal is to elect a DA who will rid them of Tiller. They don’t care about crime, they care about life BEFORE birth.
In 1995, Mark Schoenhofer filed for bankruptcy in Topeka, Kansas. He has recently alleged that he filed for bankruptcy because after graduating from law school, he had more than $100,000 in student loans and couldn’t support his wife and two children on a beginning attorney’s salary.
Note: Washburn Law School Tuition at the time of Schoenhofer’s attendance for a full three (3) year program was less than $15,000.
Note: In addition to his claim of over $100,000 in school loans, Schoenhofer had also amassed over $25,000 in unsecured credit card loans to banks and clothing stores and unpaid state and federal income taxes. [Bankruptcy Records - Case No. 95-41464]
In June of 2005, the State of Kansas Department of revenue issued a tax warrant to levy on the property of Mark Schoenhofer for failure to pay state income taxes for the years 2001 and 2003. [District Court of Sedgwick County Kansas Tax Warrant Case No. 05 ST 6401C]
Between April of 2003 and May 25th of 2008, Wichita Police Department officers were notified of seven (7) domestic disturbances at the home of Mark Schoenhofer and his wife.
In May of 2003, wife reported that her husband pushed her in the chest and hit her two times in the chest causing visible injuries. A medical referral was given by the officers and photos were taken by the police. A pick up was issued for Mark Schoenhofer for domestic battery after he had left the scene. [WPD records]
In May of 2004, wife reported that her husband grabbed her forearms and pushed her. No visible injuries , medical or photos.
In July of 2005, wife reported that Mark Schoenhofer pushed her with his hands on her collar bone area causing her to fall and slide on the floor. Husband was gone prior to police arrival. Case classified as a Domestic Violence with Children present. [WPD records]
In May of 2008, wife reports being battered by Mark Schoenhofer by being pushed against the wall and then choked. Wife requested prosecution for domestic violence. [WPD records]
NOTE: At the time of the Wichita Eagle interviews of Mark Schoenhofer and his wife, both claimed, despite Wichita Police Reports to the contrary, that there had never been any incidents of domestic violence in their home.
FAILURE TO PAY STATE AND FEDERAL INCOME TAXES
In December of 2007, the Final Entry of Judgment in the Schoenhofer divorce revealed that he had not paid
Kansas and Federal Income Tax for the period of (2004-2007) and that his tax liability was $325,000.00 [District Court Records Case No. 06 DM 8145]

You can not prosecute every case that is presented to the DA’s office. their just are not enough prosecutors or judges to handle them. They have to pick and choose. The DA has prosecuted many high profile cases during her time in office. He opposition, well look at his record. He can not even manage his own financial affairs how would he be able to manage the larges DA’s office in the state.
This is a race like that of County Commissioner Norton that the Republicans could have won if they ran good qualified candidates not buffoons with personal, legal, and financial probelms

For the record we care about children after they are born also….unlike Nola Foulston who has done more to make Sedgwick County the Child Removal Capitol of the United States and cover it up by not counting the kids taken by the WPD as a PPO for up to eleven days with no proof against the parents. The kids are just pawns in a money making scam.
Don Jordan, Secretary of SRS made comments to a group of parents…freely. He told straight out that Nola and her ADAs were bulling and forcing the social workers to put statements in affidavits and reports that were not true in order to remove even more children from safe homes. Things that they did not believe….Don Jordan did not retract his statement freely…he said he was sorry to Nola and made the excuse that he was pandering to the parents….that was his first lie in that situation. He apologized to Nola to save his job. It was still a truthful statement freely given to the parents.
Rep. Jason P. Watkins made this comment about the situation concerning Don Jordan and the DA/SRS debacle in a letter to House Speaker Melvin Neufeld and Judiciary Chair Mike O’Neal.
“As both of you are well aware, these claims, complaints and accusations are not new. In fact,a Legislative Post Audit was requested and conducted a few years ago. That audit found several problems as they pertained to the Judicial Branch and SRS relating to child welfare. However, it now appears that in addition to none of the highlighted problems being addressed, they have actually become worse. There are now former SRS employees who are coming forward with horror stories about the corruption within the child welfare system. Indeed Secretary Jordan has been recorded as saying these problems do exist. Although he later recanted, I think this was due to “political pressure” not a realization that his comments were in error.”
Kansas Senator Jean Schodorf says she’s heard from case workers who claim Jordan was right the first time. “At least six months of complaints about the way cases were handeled, not only in the DA’s office, case workers, numerous things, Senator Schodorf said.
Schodorf contacted Attorney General Steven Six and asked for an investigation, but recently received a letter back from him stating, “That it is my understanding that the secretary has since issued a retraction and without further evidence I do not believe an investigation by my office is warranted at this time”. Since when did retraction make everything all right? That was a political manuver to cover Nola probably by order of Kathleen Sebelius.
A number of case workers, including Susan, a former SRS social worker contacted KSN.
Susan said:
“My concern is that too many of the children are staying in custody that don’t need to be in custody for any length of time.
The other workers weren’t willing to go on camera, but all claimed that information was sometimes adjusted at the demands of a prosecutor from the Sedgwick County DA’s office.
Susan estimates information would be adjusted in about 20 to 30 percent of the cases and that ’someone’ would bully her into saying something she didn?t want to say. Don Jordan said that the social workers were screamed at, cussed at and felt threatened with their jobs by the ADAs in Nola’s office.
The attorney general refused KSN’s request for an interview on the matter. His spokesperson says if further evidence were presented to his office he would consider investigating, but until then, no further discussion is necessary.
“I was disappointed, Senator Schodorf said. Just the fact that he said he didn’t think one was needed, negating all of the complaints over the past six months.
Just because Steven Six (another Democrat) made the decision to not investigate does not make the issue go away. The arrogance of denying due process and investigation shows that there is something to hide. It is time to clear out the rats nest in Kansas.
These things have happened and we have more proof of the wrongdoing, law breaking, perjury and we fully intend to hold the DA responsible. The parents who have been railroaded by Nola’s office are fighting back and…WILL NEVER QUIT.

i am voting AGAINST nola foulston because we HAVE to. put the whole abortion thing to the side for once. foulston doesn’t prosecute enough cases…period. had her office prosecuted elgin robinson when they KNEW he was abusing Chelsea Brooks, she might not have been killed. Robinson is the fool. Little did he know, Nola would never have filed a case where it was consentual sex with a child, even though the law says a child of that age cannot give consent.
She doesn’t prosecute drug cases either. You have to have a certain weight of meth or heroin or crack before they will charge the case.
She doesn’t prosecute domestic violence…the victim has to agree to give a tape recorded interview in order for their office to even consider the case. DA’s offices across the nation are cutting edge in DV prosecution, sometimes building cases without the victims help. Not our DA. She is all talk, and stabs victims in the back.
She doesn’t prosecute auto theft. Your car is stolen and they catch the guy driving it a month later….the case is charged as a misdemeanor.
She doesn’t chage DUI. You are a smart drunk and you refuse to take the breath test….great idea because it is very unlikely to be charged as a felony even though it is your third, fourth or fifth.
Nola says she can’t take these cases because they don’t have enough prosecutors, yet she chooses to spend $100,000 on office renovation and brags that she returns money back to the general funds each year. why would you do that? why wouldn’t you hire more prosecutors to try to hold some of these criminals accountable.
sure, nola has a great win record. but it isn’t hard to win when you take only the most perfect cases. start taking some tough cases, then brag about your win/loss. the way i see it, having a few losses in your column is a good thing because it shows you are taking tough cases and trying to protect the community.

Violent crime in Wichita, including forcible rape and aggravated assault, have risen so much that now Wichita is a more dangerous place to live than Detroit, Michigan. Our community is above the national average for both violent crimes and property crimes, according to FBI crime statistics. That is because Foulston refuses to prosecute over 1,000 cases per year.
In order to keep her maintain bragging rights to a high conviction rate, she only prosecutes the easy cases. That means criminals go free for the benefit of Foulston’s ego.
Smaller communities ignored by Foulston
Especially affected by Foulston’s unwillingness to prosecute are Sedgwick County communities outside Wichita. The Cheney Chief of Police Howard Bishop has said that only two out of one hundred criminal cases they take to the District Attorney’s office are prosecuted. That abysmal rate of prosecution only emboldens criminals and places the people of Sedgwick County as grave risk.

Soft on crime
While many cases go unprosecuted, Foulston’s office is known for going soft on violent criminals. A case in point is the Buddy Jones murder case. Jones was accused of murdering Michelle Rawls, dismembering her body, and burying it in three places. Instead of locking him up for good, Foulston’s office gave Jones a plea bargain deal that could have him back on the streets endangering lives in only ten years.
Another shocking case involved a plea deal for a child rapist who got a lesser sentence after the DA’s office made a deal with the rapist for a lesser sentence if he agreed to allow them to voluntarily search his computer. In other words, a child rapist will soon be back on the streets to rape again because one of Foulston’s prosecutors was too lazy to get a search warrant!
SRS bullying wrongly takes kids out of homes
Families have accused the District Attorney’s office of wrongfully taking children out of families without cause. Kansas Department of Social and Rehabilitation Services Director Don Jordan accused Foulston of “bullying” SRS employees into putting false statements into court documents in order to make sure that the children are removed from their homes.
This is a shocking abuse of power and betrayal of the trust that families place in the justice system.

Speaking of abuse of power, Foulston has for years shielded friends, such as late-term abortionist George Tiller from criminal prosecution. Foulston personally submarined 30 criminal charges filed against Tiller in 2006 claiming that the Attorney General’s office did not consult her before filing the charges, an accusation later proven to be false when records surfaced of her meeting with then Attorney General Phill Kline prior to the filing.
Even though two judges determined there was probable cause to believe that Tiller had committed the crimes, Foulston never let the case be considered on its merits, allowing Tiller’s shoddy late-abortion business to continue to injure women, as happened to Patient S. in September of this year.
Foulston has been instrumental in making sure that two citizen-called grand juries investigating Tiller’s alleged criminality did not return indictments, even though one grand jury petition specifically asked that Foulston’s office not be involved in the investigation. Decorating binge costs taxpayers $105,000
While Foulston’s office apparently does not have the resources to prosecute drug dealers, baby rapists, and chronic drunk drivers that endanger the public, it does have the resources to redecorate the office in lavish fashion. Foulston spent over $105,0000 of the taxpayers’ money doing just that. One could buy a house – or hire another prosecutor – for that much money. This only goes to show how out-of-touch Foulston is with the things that really matter. Protecting the public from criminals is more important than fancy furnishings and expensive wall art.

Bullying and intimidation characterizes Foulston’s style
Foulston is well known as a vindictive bully. In 2007, she threatened with criminal charges a group of Christian leaders from a number of national pro-life/pro-family groups who had traveled to Wichita from across the country to attempt to meet with Foulston over their concerns that abortionist Tiller was violating the law.
Most attorneys who may have had aspirations to the District Attorney’s office have not run because they fear reprisals from Foulston. “She is a vindictive person who will always get even,” said one source that did not want to be identified. Perhaps that is why Foulston has run unopposed for the last 16 years.
Those fears have been realized in this election, with Foulston’s vicious personal attacks on Mark Schoenhofer. One has to admire Schoenhofer’s bravery, in the face of such spurious personal attacks on his family and his personal character – all of which have been proven to be without merit.
It is clear that Foulston’s professional record cannot stand up under scrutiny. That is why she has had to stoop to negative personal attacks against her opponent.
Foulston’s tyrannical conduct, which endangers the lives, welfare, and freedoms of the people, simply cannot be allowed to continue in the District Attorney’s office. It’s time for a change. It’s time restore justice to Sedgwick County by electing Mark Schoenhofer as District Attorney.

You have heard or read lots of anecdotal information about Mark Schoenhofer and Nola Foulston. Do you think that a paid off personal bankruptcy should disqualify him for public office? Do you believe that the people who are posting on here are lying about what has happened to them and their children?
Lots of parents were seeking help for their children, trying to protect them from a family member who had sexually assaulted them…..did it happen? NO….she prosecuted the protective parent.
Chelsea Brooks parents were trying to get help for their 13/14 year old daughter. If Nola had prosecuted Elgin Robinson for a lesser crime of rape would Chelsea and Alexa be alive today?
Look up Mark Jordan’s story of going for help and the DA collaberated with SRS to take his children.
Where there is smoke there is fire and it may be a small blaze now but more and more people are talking. There has been no justice from the DA’s office for many. There has been favors done for others. This is the reason that the parents are fighting back and telling the stories that have been told.
You tell me how you can explain genital warts in a 3 year old and Nola fails to see it as filable? Be fair in your assessment. We are looking for a fair and just system for the children. If Mark does not provide it we will turn on him too. He appears to be more honest than Nola, more caring than Nola.

How could you POSSIBLY be an effective DA in an jurisdiction such as this without having any major felony trial experience?? Really how much experience did Nola have when she was elected the first time? She had not met up with BTK or the Carrs. He has been on both sides of the law game and I believe he could handle it. Why? Why would you vote for someone who has so many complaints against her? Why would you not be as concerned about the complaints against Nola and her office as you are about the allegations against Mark Schoenhofer? Tell me why you would vote for her? Do you know her personally? Is it a social issue?
We want to tell you what Nola has done to families and vulnerable children and you want to gloss over it.
I will take my chances with Mark Schoenhofer. If he does not do right I will be against him too. I am looking for someone who will investigate complaints and prosecute crimes. This is not about who knows who….it is about the civil rights of citizens. It is about having a DA who will deal honorably in the office.
Nola Foulston should be ashamed for her failure to do her duty and prosecute Elgin ray Robinson for the previous rapes and molestion. Had she and her prosecutors done their job – Chelsea and her child would still be alive.
Chelsea’s parents should ask the attorney general of Kansas to remove Nola for her failure to uphold her office and duties per the quo warranto statues.
Kim Parker failed to prosecute another rapist of a child – Fireman Mark Jordan’s daughter.
There is a tape of her saying that she wouldn’t prosecute even if he brought a video of the man having sex with his young child.
It’s time for Kim Parker and Nola to go!
And when they go – they can take Ron Paschal with them – he condones falsification of documents to remove children from their families in Juvenile court.
Three charges of rape and indecent liberties with a child? That doesn’t surprise me – Nola doesn’t prosecute sexual abusers of children – which speaks badly for her – it shows that she doesn’t care about children. How sad for Chelsea’s family – her death could have been avoided and Chelsea and her baby would still be alive and enjoyed by her family. Nola needs to go and Marc Bennett that works for her should be appalled by his own actions – how dare he and Nola give probation to Henry Nelson – the criminal that raped an 8 year old child. Marc Bennett has the nerve to speak out about Mark Schoenhofer – we know Marc Bennett’s track record – how dare he fail our children? He and Nola are a fine pair of nothings and they both need to go!!!!

I have never met him…but he is my choice. He is running against her and that shows he has the courage to be be a stand up person in office. He has been personally attacked by Nola throughout the race and he is still pleasant in his speeches. He’s the first person to run against her in all these years. Finally we have a choice. We know Nola and we have had enough of her. The harm she has caused to the families in Sedgwick County is unbelievable. He is not Nola and that gets my support.
My question to the voters is still the same….why would you vote for a person who has so many complaints against her? Doesn’t anyone care about the children of Sedgwick County? These children will grow up and when they do they will tell what really happened. Nola has done tremendous wrong to these children.
These kids deserve better. A vote for Nola is a Vote against the children. According to Don Jordan’s statement Nola Foulston is behind the SRS debacle in Sedgwick County.
When, and if, a credible candidate runs against Foulston that person will probably get enough votes to win. Everyone I’ve spoken with isn’t voting for Foulston as much as against Schoenhofer. This is a race that could have been won, but the Republican Party fielded an unelectable candidate.
If the Republican Party continues to field such candidates as Schoenhofer, Foulston will be able to leave office when she chooses to retire but won’t have much worry about losing an election.

TTT – your opinion is duly noted. However, I think Gabel’s NUMEROUS problems will sink him. As I commented above, with Schoenofer and ONE complainant I could dismiss with “he said she said” and “Hell hath no fury” but with Gabel – how many women are making these claims? Seems like a lot to me.

What difference does it make when offenders don’t get anything but probabtion from Nola’s office? How many underage girls did Elgin Robinson molest or rape and still allowed on the street? Was that a “he said she said”, and so it was dismissed?
I believe that Mark Schoenhofer was using public information in his ad to warn the public of the DA’s practice of letting offenders walk. Chelsea’s story was not a secret it has been plastered all over the paper and the news for two years.
There are too many well known secrets in Sedgwick County. Maybe it is time that the people of Wichita were warned that there are some dangerous people who do terrible things still walking the streets thanks to Nola’s office. If the DA’s did their job right and put him in prison for rape we wouldn’t be having this discussion. There shouldn’t have been a tragedy.

I believe that Mark Schoenhofer was using public information in his ad to warn the public of the DA’s practice of letting offenders walk. Chelsea’s story was not a secret it has been plastered all over the paper and the news for two years.
There are too many well known secrets in Sedgwick County. Maybe it is time that the people of Wichita were warned that there are some dangerous people who do terrible things still walking the streets thanks to Nola’s office. If the DA’s did their job right and put him in prison for rape we wouldn’t be having this discussion. There shouldn’t have been a tragedy.

What difference does it make when offenders don’t get anything but probabtion from Nola’s office? How many underage girls did Elgin Robinson molest or rape and still allowed to be out on the street? Was that a “he said she said”, and so it was dismissed.
TTT – you still seem to have a bit of a reading comprehension problem. My “how many women” comment was about Gabel. That has nothing to do with Robinson. My “he said she said” was in DEFENSE of Schoenofer in regards to the allegations about him.
My PREDICTION stands – both Schoenofer and Gabel will lose. While Foulston and Norton were ripe for defeat (for many of the reasons discussed above) you put up incredibly poor candidates.
Oh well – perhaps Wednesday morning after your guys lose you might reflect on what went wrong.
