It’s been almost two years since Phill Kline was Kansas attorney general, but the state is still paying for it. Last week the state agreed to pay $475,000 to settle a lawsuit over Kline’s 2003 opinion that medical providers, including school nurses, must report to authorities all sexual activity by teens 15 and under, regardless of whether it’s between consenting teens. During the resulting 2006 court case that tossed out that opinion, Kline made the remarkable pronouncement that boy-on-girl oral sex must be reported, but girl-on-boy oral sex doesn’t have to be.

Ben, I don’t have the statutes then in effect before me, but IIRC, there was a differentiation made therein between boy on girl vs. girl on boy in several of the criminal statutes dealing with “sex crimes” which were to be reported. While I thought the opinion in issue was bogus ab initio, I must point out that there was at that time a statutory basis, regardless of how ridiculous it may seem, for the quoted assertion.
Sometimes it’s really unfortunate we can’t just deport people from the state! Kaflush, Phil!

Raptor, I am aware of one case that because it was an adult male and a minor who was male, the statute applicable carried a lesser penalty than if it had been the adult male and a minor who was female under the different statute applicable to the latter situation.

How in the world can an AG be sued for a legal opinion? I’d like to know more about that. Maybe GMC or Vaughn can shed some light on that.
While I tend to defer to VT and GMC I would guess that if the Court decided the ‘opinion’ was not legitimate but was rather simply a furtherence of his vendetta then a lawsuit might be justified.
As for Brownlee bringing up that other detail from the case that just cost the taxpayers a half-million - perhaps it was to show just how frivolous Phill was.

If I recall correctly, the litigation was not brought just because the opinion was issued. Rather, it was brought to seek a restraining order against enforcement of the reporting laws based upon the opinion.
Had the opinion merely been issued, and no action to enforce the reporting laws based solely thereon been taken, attempted or promised, there would not have been a case or controversy existing for a court to rule upon. That, however, was not the case as I recall. The opinion was issued by the AG’s office accompanied by at least a statement that it would be the basis for enforcement of the reporting laws as construed by the opinion. That gave the Plaintiffs the necessary standing to bring the action for a restraining order, which was granted by the court after hearing.
So, while the opinion was involved in the litigation, the suit was not merely because the opinion had been issued; it was brought because the potential existed for enforcement of the reporting laws based upon the language of the opinion (if there had not already been some enforcement action begun as the result thereof).

1) Morrison’s faults caught up with him. Between the two, he was still preferrable, IMVSO, to Phill Kline, but I am sure glad he is gone as well.

I call bullsh*t. Kline’s obsession with abortion has been clear since he was an activist. It was arguably the reason why he pursued office in the first place, first as a legislator, later as an AG. Kline investigated Tiller and Planned Parenthood in search of a crime, and his actions in doing so were predictable considering that he was a well known anti-abortion activist. Anyone who uses their statewide position to pursue their pet issues at the expense of his wider responsibilities (and make no mistake, that is what Kline did, Bryan Brown for example was in no way qualified for the position Kline appointed him for) is proving that he puts his personal obsessions above his duties. Ay any reasonable standard, Kline pursued a vendetta like Ahab pursued the white whale.
