		<description>Immigration Absurdity

The top issue on the minds of Kansas voters at the beginning of this Session was clearly that of illegal immigration.  WE demanded we deny public benefits to those illegally in our country. WE demanded an end to in-state tuition for illegal aliens. WE demanded an end to our catch-and-release approach to law enforcement. And WE demanded that businesses stop hiring illegal aliens.

However, it looks like the Kansas Legislature has stuck its head in the sand again – and refused to do much about it – other than falsely to claim progress. 

Caving into the pressure from businesses and welfare groups, both the House and Senate passed varying versions of nearly-toothless reform.  Let me explain.

First, the Senate bill.  It does very little -- but that is more than nothing. Unfortunately, some of the most rigorous proposals were eliminated - but at least the denial of illegal alien access to most tax dollars remains.

  
But the House bill is likely to worsen the situation.  Not only are businesses not part of the solution any time soon either, the House included language that potentially opens up more welfare benefits to illegal aliens than even allowed under federal law.  

For the first time, Kansas would be creating a new right for illegal aliens state financed medical care, no questions asked. 

Kansans deserve better - much, much more must be done.  But the tone-deaf Legislature just can’t seem to listen very well on this issue – but that is what elections are for…  Unless major changes are made to these bills during the Veto Session, illegal aliens will have once again evaded the wrath of Kansas citizens.  

Below is a summary of some of the absurd immigration provisions:

·         In-state tuition subsidies will continue for illegal aliens – in clear violation of federal law.  Meanwhile, the Senate refused to allow nearly 70 brave ROTC Cadets to have access to the same in-state tuition rates.  Hmm…illegal aliens deserve taxpayer help, but not the young men and women who have already committed to four years of military service?


·         The bill requires these illegal alien students to file an affidavit with a new Illegal Immigration Enforcement Division in the Attorney General’s Office stating that the person is working toward citizenship.  Yes, that’s right.  These illegal aliens must report to the very office supposedly tasked with stopping illegal immigration!


·         Besides, this affidavit to work toward citizenship is simply legal fiction.  Those illegally in our country can not even begin the citizenship process until they return to their home country – and can never legally work here. 

 
·         Refuses to allow local law enforcement to inquire into the immigration status of those we arrest for crimes – for we just might learn the extent of the criminal problems associated with illegal aliens.  Maricopa County (Arizona) Sheriff Joe Arpaio would be persona non grata in Kansas.


·         Lack of law enforcement cooperation between federal and state authorities will permit the development of sanctuary cities.


·         Continues to allow businesses to take a tax deduction for the hiring of illegal aliens.
·         Claims of fines or jail terms for employers who hire illegal alien workers is simply not true.  The provisions in the bill only permit a civil contempt of court charge and are essentially unenforceable.  Additionally, they likely preempt federal law – and will not withstand legal challenge as a result.  I predict absolutely no employer will be fined or serve a day in jail under these provisions.


·         Penalizes unions up to $2,000 for having illegal aliens as members – meanwhile, no fines for the employers who hire these illegal workers.

·         Continues the don’t-ask-don’t-tell approach to many welfare benefits.  The Senate rejected my amendment to require proof of lawful presence for all government benefits – instead we just take the word of the applicant.</description>
		<content:encoded><![CDATA[<p>Immigration Absurdity</p>
<p>The top issue on the minds of Kansas voters at the beginning of this Session was clearly that of illegal immigration.  WE demanded we deny public benefits to those illegally in our country. WE demanded an end to in-state tuition for illegal aliens. WE demanded an end to our catch-and-release approach to law enforcement. And WE demanded that businesses stop hiring illegal aliens.</p>
<p>However, it looks like the Kansas Legislature has stuck its head in the sand again – and refused to do much about it – other than falsely to claim progress. </p>
<p>Caving into the pressure from businesses and welfare groups, both the House and Senate passed varying versions of nearly-toothless reform.  Let me explain.</p>
<p>First, the Senate bill.  It does very little &#8212; but that is more than nothing. Unfortunately, some of the most rigorous proposals were eliminated &#8211; but at least the denial of illegal alien access to most tax dollars remains.</p>
<p>But the House bill is likely to worsen the situation.  Not only are businesses not part of the solution any time soon either, the House included language that potentially opens up more welfare benefits to illegal aliens than even allowed under federal law.  </p>
<p>For the first time, Kansas would be creating a new right for illegal aliens state financed medical care, no questions asked. </p>
<p>Kansans deserve better &#8211; much, much more must be done.  But the tone-deaf Legislature just can’t seem to listen very well on this issue – but that is what elections are for…  Unless major changes are made to these bills during the Veto Session, illegal aliens will have once again evaded the wrath of Kansas citizens.  </p>
<p>Below is a summary of some of the absurd immigration provisions:</p>
<p>·         In-state tuition subsidies will continue for illegal aliens – in clear violation of federal law.  Meanwhile, the Senate refused to allow nearly 70 brave ROTC Cadets to have access to the same in-state tuition rates.  Hmm…illegal aliens deserve taxpayer help, but not the young men and women who have already committed to four years of military service?</p>
<p>·         The bill requires these illegal alien students to file an affidavit with a new Illegal Immigration Enforcement Division in the Attorney General’s Office stating that the person is working toward citizenship.  Yes, that’s right.  These illegal aliens must report to the very office supposedly tasked with stopping illegal immigration!</p>
