Check the above link to see that Obama, as chair of the IL State Senate Health & Human Services Committee in 2003, STOPPED identical Born Alive Infant Protection Act federal language from being introduced in IL.

Federal law apples mostly civil penalties. State laws apply criminal penalties. That’s why state laws are needed.

Incidentally, the identical language to federal BAIPA did pass in IL in 2005, the year after Obama left the state senate.
