    All this time I thought banks were reporting the cash transactions of their customers to the feds to catch terrorist. Guess they were right, Wall Street crooks were terrified of Spitzer.

    I don’t know why this surprised me so much, but it certainly did. It smarts of playground bullies trying to keep others off of swings and things. And we wonder why society is turning out youth who are so ‘me’ orientated.

    La Jolla activist wants bench-warmers to block transient sleepers

    SAN DIEGO—A community activist thinks a few couch potatoes, strategically placed on sidewalk benches in an upscale La Jolla shopping district, will keep transients on their feet and on the move.
    Esther Viti, who oversees the donation of public benches for a local merchants’ association, sent an e-mail to 45 other activists last week asking them to sit in three-hour shifts, no bathroom breaks allowed.
    “After all, you MUST OCCUPY THAT BENCH continually for three hours to prevent that homeless person from sitting on that bench,” the e-mail said.
    Viti said donors weren’t happy that transients were sleeping on benches they had provided for the public.
    The group initially tried to combat the problem by installing benches with metal dividers that split the seats. Transients simply began sleeping upright, said Deborah Marengo, president of the merchants’ group Promote La Jolla.
    Viti said the bench-warming idea came from San Diego police Capt. Shelley Zimmerman during a conversation about how to combat the problem. Zimmerman said she explained to Viti that homeless people have as much right to sit on public benches as anyone else.
    Viti said no one has offered to sit a shift yet. Some potential recruits expressed concern that the bench brigade could provoke retaliation from displaced transients.
    Professionals who deal with homeless issues said Viti’s strategy might succeed in getting people to move on, but would do nothing to address the underlying problem of homelessness.
    “It’s pointless and a waste of time,” said Rosemary Johnston, program director for the Interfaith Shelter Network.
    In 2006, the Regional Task Force on Homeless estimated the homeless population at 9,600 countywide, which included 4,400 people within the city of San Diego.

    Excellent editorial by Davis Merritt in the Eagle today. I despise the practice of pundits treating an election like a sporting event (sort of like the playoffs or an NCAA tournament). If it wasn’t for organizations like factcheck.org, you wouldn’t be hearing at all about the truthfulness of what a candidate said, only about whether it was effective.

    I, for one, am really, really sick of the Cokie Roberts and Tim Russerts of the world.

    Speaking of ME oriented culture, does anyone else find those Cheeto commercials just downright wrong?

    I don’t get my way, someone is being rude to me, so I can be obnoxious back?

    I’m really not liking the examples out there. There’s one Capn Morgan commercial where the lady calls, he’s at the bar, and everyone is lying for him. He comes out the hero, and she looking gullible for believeing him.

    No wonder society is going to pot, look at these fine examples.

    Kansas Supreme Court holds the Kansas funeral picketing law unconstitutional. Per the article, the constitutional defect is the “triggering” provision.

    Ah, an opinion a Constitutional law professor to love. Skimming it (don’t have time to give it a full, careful reading), the constitutional issue involves a violation of the separation of powers doctrine. Further infirmity is found in the absence of a “case or controversy”, thereby asking a court to give an advisory opinion, which is not a proper function of an appellate court. Have fun with this.

    As much as I hate the Phelps bunch, it seems to me that the Kansas Supreme Court is telling the Legislature to man up and make its own decisions and quit trying to push the difficult legislative decisions off on the court.

    I am aware that the legislature is concerned that there will be a court challenge of the law, if one be passed without the provision found to be unconstitutional, which could lead to a great deal of time and expense. The worst scenario is that after trial, appeals, etc., the law is declared unconstitutional, and the legislature would again be forced to deal with it (not to mention the potential for damages to be paid). The legislature tried to get an advisory opinion; it failed. So, as Dennis says, it is time for it to “man up”.

    As a nonlawyer, i am not familiar (and don;t want to take the time to look up) all the cites. However, it seems to me that the Supreme Court made a very persuasive argument, and like Dennis, I think it is time for the legislature to “man up”
    and think for itself. It seems to me that by decision, and plain logic, it is not the role of the Supreme COurt to be an advisory body to the legislature.

    I have to say that I did a double-take when I read the obit this morning – the name just caught my eye – but I did notice the difference in spelling.

    What is really sad is that a 20 year old young man has lost his life – far too young to die.

    I planted 1,800 onions yesterday, and have about that many to plant for today. 300 lb of seed potatoes next week.

    100 baby chicks in the next two weeks.

    Damn, spring isnt even officially here, and I’m already six weeks behind.

    And ready for ripe juicy tomatoes. Oh well, a girl can dream. heheheheh.

I have seen the spelling of YOUR last name… I DO know how to read… I was interested in the young man in the Obituary… because he had enough insight to have a Donor Card, and save the lives of at least FIVE people in his untimely death….
