Did you notice the real estate advertisement for three downtown Wichita high-profile buildings that are FOR SALE? It was contained in the EAGLE’s business section this AM. One is the historic Union Station on Douglas.
Wonder what that is all about?

Well this is the second day or relative freedom, without going into the graphic details my ties to Wal-Mart are severed. The world is now my Oyster, but at this point instead of a pearl I seem only to find the grain of sand within it at the moment. Its for the best I am sure.
Has anyone else suffered from this weird flu that’s been decimating Wichita this year? It starts out as extreme, debilitating fatigue – but no fever. Then you get a mild cough – but no fever. Then the cough gets worse – and fever hits. And THEN…….
One minute you feel better – the next you feel like the diseased issue of a very diseased Cro-Magnon woman.
Whatever it is – it s–ks. Does anyone know how long this crud is supposed to last? Some kind soul told me “two weeks” – and I said, “Oh, hay-ull no.” Ain’t no way I can last two weeks with this crap.
And the worst part is: Evidently this year’s flu shot is ineffective against this particular virus. Whatever it is – I feel like a s–t-salad stroganoff right about now. And it’s getting old. It’s getting REAL, REAL old.
When I get the flu (like once every 15 years) – it’s 24 hours of pukin’ – and then it’s gone. This virus ain’t like that – it hangs on longer than Hugh Hefner’s priapism.
Please – does anyone have any words of hope for this miserable sinner, er, sufferer? I’m about to pack it in…………..

It would seem Songbird that there are several strains going around now. Some more virulent than others, less than half of them covered by the last vaccine.
From you description it would appear you have one of the worst. Plenty of fluids, rest and hang in there!

I’ve had it. Every time I think it’s gone it comes back. I had the flu-like stuff over 3 weeks ago. The head cold symptoms and sore throat keep coming back. Thought I was over it again 2 days ago. Blew a quart of bloody snot out of my sinuses this morning.

This morning I am giving serious thought to perhaps it is time to go it on my own. I have often sighted that this town is lacking in some areas. And simply finding the correct area of endeavor could pay off, I know it does not involve cake decorating or Antiques as neither seem to be able to make it passed six months.
I know the CC of Augusta would just love to see some more Varity uptown, something that would both serve the community yet draw some traffic from the highway and the surrounding area. I myself want something that would have some staying power. But that means some uniqueness to it and would be more convenient than a run to Wichita. I would have to compete with Wichita, El Dorado is easy as I often describe it as “Plain as Vanilla”. But whom knows? This will takes some more thought, though my playing ability leave quite a bit to be desired, I wonder if a Music store/ Guitar store might make it. There are local Guitars teacher that would like to have a place they could work out of to give lessons. It would also be valuable to at least carry used band instruments. There is a unspoken demand for them here as both the middle school and High school have band programs.
LOL it somewhat makes me feel like the child with only fifty cents standing in front of the candy store.
Songbird I had it last week and had not been that sick in recent memory! It hit so suddenly and with such odd effects that I wondered if it might actually be a heart attack (it also played a part in my separation from WM)! For the first three days I could barely set in bed and like you describe had barely enough energy to get up to go to the bathroom. The days and nights melted into one and I have little memory of those days.
It became also most a relief when it just started feeling like a bad cold!
LOL yes JR, have you ever seen the documentary “the high cost of low prices”? I just recently watched it on youtube and I have to agree with most of it in hindsight.

There’s a lot of opportunity out there! Twenty years ago I started a software consulting service tailored toward chiropractors.
There was a pretty good company that was basically selling exclusively through trade magazines. I called them up and sold them on my services. Told them they needed me!
Sold software, consulting and in office instruction for two years. Wrote a monthly column for a magazine and built up a pretty good business.
Problem was, I had pretty much sold everyone interested in Sedgwick, CO and I was in western Kansas a lot over night. The company wanted me to take over Oklahoma and Texas. Newly married, not interested!
People still call me and ask me for help today! They no longer have my stuff but I’m easier to talk to than someone in tech support located in New Delhi!
It was a pretty good gig and I didn’t need a ladder!

As an El Doradan and guitarist, come on over. I wish I could tell you the market is ripe, but it would be a struggle. For one thing, you’re in direct competition with the Wichita stores (Ulick, MDP, etc.) as well as Guitar Center. You’re right, you’d have to be broad-based; entry level gear, band instruments, and probably karaoke stuff too. But there’s probably a market here.
Of course, now would be a tough time to start a new business, given all the economic uncertainty.
As a nurse, I’ve seen this horrible flu take over the city. Blame the overuse of antibiotics by the health care industry for the super bugs we now have to endure. I’ve even known of two elderly people who died as a result of getting this crap.

I heard ol’ Dalton Grimsley (or whatever his name is) on the radio the other day talking about ICE, which stands for In Case (of) Emergency. Set up your emergency contact number (spouse, parent, kid, whomever) under ICE. If you aren’t physically able to use your phone, the number is there for emergency service people to contact. Multiple contacts can be labeled as ICE1, ICE2, etc.
All true GMC, but I think the secret would be “warmth” as a fledgling player I made a trip to the Mecca for guitarist “C and C music” on Hillside. I was in heaven until the clerk finished with the last customer at the register. Once he discovered I was not a band member with a top name band. The temperature suddenly fell fifty degrees. Sadly to a lesser degree that is the experience at most of the shop I have been to in Wichita.
For the most part the only one I have found I was truly welcome at is “Kathy’s” on Lincoln past G. Washington but Senseny music the first time was a treat, I got to play a 68 gold top Les Paul! OMG , when I died I hope that St. Pete hands me one as I walk through Pearly gates! Talk about HEAVEN!
Since I have a Ovation Balladeer, I had find Uhlok music a good place and they took the time to answer questions and just let me talk. LOL I am starting to sound like a food critic!
As you are aware, particularly new guitarist need to be nurtured and even the more experienced love to talk with others. Selling a guitar is one of the easiest things in the world, you simply get it into their hands, teach them the easiest one note song like “ole to joy” or even “Love me tender”. Show them they can play and you have a sale! Getting teachers involved would only add to current and future sales, whether they are good or bad teachers it would be the same. I would rather hook up with a good teacher that could work out of the shop. It would draw people from some ways and the beginners would have the true benefits. I have had three teachers in my life and they varied in degrees. The first was good as she taught the ridged basics and brought you along at your own pace. The second was a band member for twenty some odd years, the problem I guess it though just because you can play a guitar for a living. Does not mean you can teach other to play. The third whom I would like to get back with, he was a little too laid back. Though he was helpful he tended to play his own guitar ( Or after a bit one of mine) while I was playing and it made it harder to hear myself. Especially since he would more pick a different rhythm that I was. But he was a good in-between. But any song I wanted to play he could teach and write out with ease.
Can you tell this has been one of those back of the mind thought for sometime?
Writerdog, you go man. When the economy is down is the BEST time to start a business. It is scary as hell being self employed, but IMHO, well worth the risk, the fear, the uncertainty and the looks from family and friends.
Contact your local Small Business Development Center. Iknow there is one at WSU, maybe one at your local community college.
I dont know if you are near an Enterprise Facicilitation group, but the SBDC should be able to tell you.
And… if possible…. dont borrow any money. Bootstrap if you can. It may be slow going, but build up your own reserves.
And write a business plan. Your local SBDC can help, and there’s lots of business plan help for free over the internet. If you cant make it work on paper, you cant make it work in real life either.

I love having rental properties, it’s an investment that pays well and will give me an income for as long as I want it to. I plan to buy more in the next couple of years so that I can retire from my day job.

Ron Paul had Ben Bernanke up against a wall Wednesday during the House Financial Services Committee. Dr. Paul raised the issue of the dollar’s deliberate destruction and how it directly relates to higher prices. After Bernanke shot back at Paul saying that they had to look at price stability, and aimed for low domestic inflation. Paul thenhighlighted the fact that the M3 money supply was rising at a rate of 16 per cent and that this was the real rate of inflation.
“History is against you,” Paul told Bernanke, “History is on the side of hard money – if you look at stable prices you have to look at the only historic sound money that’s lasted more than a few years – fiat money always ends, gold is the only thing where you get stable prices,” he added, pointing out that despite the price of oil’s rapid ascent, it had remained flat when compared to the price of gold.
Bernanke in the end agreed with Paul saying if the oil prices continue to rise like 2007 it will be hard to maintain low inflation.

Yes, buying a guitar is a holy experience. The interplay of wood, metal, electronics (if you’re into that), when you find the right one for you, is indeed magic. A row of “identical” guitars is discovered not to be identical at all, of course. I’m currently building my second (a Part-o-caster, but uniquely mine, and filling a void in the collection), and have, oh, 7 or so in the house (2 Custom Balladeers). Plus related stuff.
And since you’ve played, you know that when a band finds that magic pocket, it is also a mind-blowing experience, when the sum of the parts becomes greater than the whole. I’ve been fortunate enought to have that moment a few time; damn, it’s fun. I’m a mediocre guitarist, but I find my niche just the same, and enjoy the hell out of it.
I’ve got my own back of the mind thoughts over here. Maybe we should hook up; we might be able to help each other.

My kid is interested in the guitar. I don’t know much about them. I played the sax for awhile.
We picked up a Peavey acoustical and a Peavey electric guitar after Christmas on clearance at Penney’s. They seem pretty nice and we only paid about $40 for each. heh I kinda like the electric one myself. But it is put away for my son’s birthday.
Dog- As you know, if you open your shop, your major competition will the Guitar Center in Wichita , and Musician’s Friend on line( I’ve purchased 11 guitars in the last 2 years). In defense, I would pay more for knowledgeable, hands on experience at a local establishment. I used to buy strings , etc. at E.M. Shorts for 15 years. That is until during the last 3 times I tried to purchase strings and couldn’t get anyone to stop BSing and help me. I subsequently removed their agony of suffering my business by leaving then forever.

My 93 year old mom is in the hospital with it. She was in for an unrelated treatment 4 weeks ago and caught it there. Turned into double pneumonia and other complications. She’s tough. The doctors said at her age she probably wouldn’t make it. As of yesterday she was sitting up and demanding to go home. And Ben they gave her chicken soup everyday. One of the few things she could keep down and I think it cured her.
So far none of the rest of the family has caught it from her. My hands are practically bloody from frequent washings though.
Writer glad to hear the flu is gone. I’m trying to think of a business opp that is just waiting for you. It’s there just keep looking and keep that hammer and ladder handy. Spring is almost here.

If you can provide that, you are a leg up on the on-line retailers. And you can compete (it’s also in part the way to compete against Wal-Mart).

Dog my favorite place to shop for guitars is in a pawnshop. Bought our last two there. The one on Broadway and Harry has a very knowledgeable guy there to answer question for us non-musical grandparents buying for grandkids. I love having someone who knows their products to talk to. They also stock all of the accessories – straps, bags, picks, etc…. Contrary to most beliefs their merchandise isn’t all used. They already have a store front and use it to sell other products. You would be good at that.
I agree on the over the top thing GMC. Most don’t understand the 2nd Amendment is about maintaining Freedom. So I go Cosmos on the 2nd Amendment issue.
If Democrats will believe that Obama supports the 2nd Amendment because HE SAYS SO, then the Democrats are dumber then I thought they were.

the Business community has a kind of love hate relationship with Da Mayor — he’s done wonders for downtown, the mag mile, getting O’Hare expanded (think its crowded now – wait til construction begins) he landed Boeing Hqrtrs over Dallas, is a serious candidate for the 2016 Summer Olympics —- brings a lot of jobs to the city — but then he closes Meigs Field overnight w/o telling anyone, has tried everything to fix the Public Schools without a lot of major improvemnts in performance, if ya need to get something done through the city — won’t do a lot of good by going to the approval office, got to go through ur alderman if ya really want anything expedited …… Chicagoans really think they are a city that “Works” — in spite of the cost

I’d come over and look at your shop. I play mainly finger style guitar – have no rhythm, can’t dance – thus not good at strumming. But can tickle those strings.
I still have a Martin D-28, but don’t play it much, unless inspired by Neil Young or someone. Gave my stratocaster to a newphew who started a Christian band that was kept pretty busy – there was a larger market for that kind of material than I thought.
I have an OM-19 that is a Larrivee – handmade by a husband and wife in British Columbia. It is a much better guitar than I am a player. I usually play country style blues (which includes a fair share of gospel) by folks like Mississippi John Hurt and Rev. Gary Davis – electified versions of these songs were covered by Hot Tuna – an offshoot of Jefferson Airplane – back in the day.
I am not great at my craft, but I really enjoy it.

The most incredible guitar I ever picked up was in a pawnshop in Lawrence, and it was a steal, but I tried for another $100 and lost it. Oh well; it was also the only decent guitar I ever found in a pawn shop. BTW the pawnshop (on sixth i think, or maybe ninth) in lawrence was/is one of two pawn shops I’ve ever visted that weren’t total rips. The other was in bentonville ark.
Other than the lawrence pawnshop, I’ve never found a decent guitar in any pawnshop, though many do cell (sell — phonetic typing, a growing problem as I age) cheap new models, for about double what you could get them for from any on-line discount house.

I’d cover the sausage (rope or link?) with kraut, apples, garlic and onions. (If you want to lower the fat, you can brown the sausage first, but deglaze the pan with beer after you pour oof the fat and add that to the kraut mix.)
I’d use seventy five percent as much onions as kraut, with a large granny smith apple and a few (4 or 5) cloves of garlic. How many depends on if the sausage is garlicy or not. Dont chop up the garlic. Put the cloves in whole. Or better yet…
Roast a whole head of garlic in the oven, (cut across the top to open in, pour olive oil over, then bake at 350 until soft) then squeeze the head and put in the roasted paste. Then slowly saute the onions in butter and it will all be sweeeeeeet. Mix the onions and garlic with the kraut and big chunks of apples and more sliced raw onions and cover the sausage. You can add a half cup of dark beer now if you didnt brown the sausage and deglaze the pan.
Needless to say, I like the full fat version, but our sausage is pretty lean.
Seal the whole deal with foil, bake for an hour or so at 350.
Serve with mashed potatoes.

Hmmmm…. fried chicken.
Seasoning secret is Tony Chacherre’s and lots of it. Both on the chicken and in the flour.
Season chicken, let it sit for a few minutes, roll it in flour, let it sit for a few minutes while the oil (about an inch) is heating. I use plain veggie oil.
When the oil is 350 or so (no higher) roll chicken in flour again, then put pieces of similar size in pan. I.e. I fry wings and legs together and thighs and big breast pieces together. (Yeah, I’m a breast woman :) Dont let pieces touch each other.
Fry for 10 minutes a side for little pieces, 15 minutes per side for big pieces. Cover the pan while cooking, try to turn it only once. Sometimes you have to fry on three sides to get it good and brown.
Drain it on a rack as it comes out of the oven. Dont drain on paper towels. That makes it soggy ’cause it actually generates steam. Immediately after it comes out of the pan, hit it LIGHTLY with Tony’s again.
Serve hot with a side of garden hose ’cause it’s gonna be juicy.
Mashed potatoes and cream style corn. Sliced tomatoes and cukes if ya got em. Sweet tea, yeast rolls, and apple pie if you can stand it.
Nap for five hours….
Hee hee hee… at my restaurant, I warned the staff that nothing went out of the kitchen without Tony’s on it except dessert.
Fried chicken … about 1 inch peanut oil – hot. ‘Bread’ the chicken with seasoned flour – include Tobasco in the flour mix. Now for the trick: CAREFULLY add about a half-cup water to the oil and CAREFULLY cover. The steam helps keep the chicken juicy.
Need to turn it halfway through and add a bit more water.
Messy but good.
And speaking of wine… if you dont have dark beer, you can deglaze the pan with a little white wine. Reisling (sp?) if ya got it.
Well, I added Lone Star later, but in San Antonio, it was Pearl – because there was a Pearl Brewery there. (Lone Star – real Texans comment.)
The people outside of San Antonio, the Austinites, Houstonians and Drug Store Cowbows of Dallas, Fort Worth drank Lone Star.
In West Texas, curiously enough they liked Pearl – cheaper I guess?

Years ago, when I was living in Cajun country, I asked “the best cook in town” for her recipes.
She was about 4-foot-seven and three hundred years old. She said “it all depends on your roux.”
I told he I knew that, but how did she fix her roux? What do you put in it?!
And she looked me in the eyes with all sincerity and said, “Whatever you think is right.”
I had the good fortune to travel through the genuine Louisiana bayous one Mardi Gras where a horse-drawn wagon visited all the homes and collected whatever the individual families chose to contribute into a community pot. It was brought back to the main town where the old Cajun ladies stirred a pot the size of Act 1, Scene 1 of “Macbeth.” They had their roux made and the rest of the stuff, from all the rest of the people, went into the community pot. And then the band started.
Three or four hours later, after dancing and drinking, everyone ate out of the same pot. Pork and crawfish, home-smoked bacon and “Weldon Brussard’s Sausage” and okra and rice and the damnedest combinations of spices (from the old women’s roux) was one of my Top Five Meals Ever.
And, as I think about my Top Five Meals Ever, it’s not just the food, but the company. It’s not just the company, but the food. We’ve all had ‘em.
Might make for an interesting thread.

I’ve had good luck with my garden in the past – right up until harvest. The first round or two of cukes and squash are fine. Then the vines die. I’ve been told it is how I harvest – where I cut it away – but not told what I was doing wrong. Where do you cut them when ripe from the vine?

PICK the fruits, dont cut them. Pull the stem off the vine. The plant WANTS to go to seed. It has a need to reproduce, just like animals, and if it thinks it isnt going to seed, it will put on more fruit. Make sense? So pulling the fruit, stem and all, from the vine, makes them think some mean animal chomped it off. It gets pissed and puts on MORE fruit with a vengence.
Some varieties dont get more than two rounds or so. I like heirloom varieties, and the seed packets will tell ya if they are or not.
Sometimes they quit producing in the heat too.
But try stressing the roots as well. This works for tomatoes. Take a big knife and cut a circle in the soil, about a foot around the main stem. It cuts the roots underground, alarms the plant, and again, it puts on fruit like crazy. This is good if it’s just blooming and wont set. Or if no blooms either.
Make sure the soil has lots of nutrients. Put on poop if you are an organic grower, Miracle Grow if you arent.
Also, dont let the fruits get too big. Leaving overgrown fruit on the vine makes the plant relax and think it’s done it’s job for posterity. Pick early and pick often is my motto :)

The key to any start up biz, as I said to writerdog, is a business plan. Do a conservative one, with cash flow projections, and that will help you determine your operating costs. Better have access to enough money to operate for a year. Like I told WD, if you cant make it work on paper, it wont work in real life either.
Start up costs are for what it takes to open the doors. Equipment, fees, licenses, inventory, and hiring and training money. Operating costs are ongoing AFTER the doors are open. You need to figure both. Dont buy what you can lease.
The other key, besides access to capital, are your employees. I lost a lot of money at first until I got a good crew together. Stupid and lazy employees will cost you your business.
Also key for food businesses is portion control and pricing. Gotta keep the food costs below thirty percent. Make friends with your food vendors. They can make ya or break ya.
Yeah Grm, Jack is way cool to talk with and there are some very good guitars there because of Jack.
BTW if you go in there again and see some tall guy that looks like a balding, mustached Neil Diamond walking around. Tell him you know someone who said he is STILL uglier then I am! He will know who you are talking about. LOL

BTW JR if you did not read in my post above, its important that your son gets with someone that can help him through the beginning of playing his guitar. It does not have to be a paid teacher, most people who just how played for a couple of years can help as long as they remember they are not dealing with someone who already plays. As I said he need to first find out he can play a guitar with a simple song. Then would be the time to get with a good teacher.

Navy officials on Thursday told FOX News the USS Cole was in the Mediterranean Sea after earlier reports said the ship was off the coast of Lebanon in a “show of support” for Lebanon’s regional stability.
A senior official said the United States blames Syria for political deadlock in Lebanon, Reuters reported.
The USS Cole left Malta on Tuesday for the eastern Mediterranean “in support of a U.S. commitment to regional stability,” according to one senior defense official who also said President Bush is concerned about stability during Lebanon’s March 11 election.
The USS Cole was to be accompanied directly by two Navy oilers. Three other Navy vessels also were headed to the Mediterranean as part of a regularly scheduled deployment: the USS Ross destroyer, the USS Nassau amphibious assault ship and the USS Philippine Sea cruiser.
Al Qaeda operatives bombed the USS Cole in 2000, killing 17 U.S. sailors and nearly sinking the $1 billion warship in Aden Harbor, Yemen.
This month the United States expanded economic sanctions on Syria, saying it is responsible for destabilizing Lebanon.

The ethanol boom is running out of gas as corn prices spike.
NEW YORK (Fortune) — Cargill announces it’s scrapping plans for a $200 million ethanol plant near Topeka, Kan. A judge approves the bankruptcy sale of an unfinished ethanol plant in Canton, Ill.. And that was just Tuesday.
Indeed, plans for as many as 50 new ethanol plants have been shelved in recent months, as Wall Street pulls back from the sector, says Paul Ho, a Credit Suisse investment banker specializing in alternative energy. Financing for new ethanol plants, Ho says, “has been shut down.”
How can the ethanol industry be slumping only two months after Congress passed an energy bill most experts consider a biofuels boon? The answer is runaway corn prices.
Spurred by an ethanol plant construction binge, corn prices have gone stratospheric, soaring from below $2 a bushel in 2006 to over $5.25 a bushel today. As a result, it’s become difficult for ethanol plants to make a healthy profit, even with oil at $100 a barrel.

THE OLD MAN IS NOT SQUEAKY CLEAN AS HE SAYS
Not all conservatives thought the Times was off-base in going after McCain’s ties to lobbyists. These activists are angry that McCain is surrounded by lobbyists who put corporate interests ahead of conservative interests. They note, for example, that it has been impossible to get McCain to firmly commit to opposing the U.N.’s Law of the Sea Treaty. McCain has also indicated support for the International Criminal Court.
Five weeks ago a conservative coalition sent a letter to McCain asking for clarification of his position on the Law of the Sea Treaty. There has been no response.
Some inquiries on this matter to McCain’s presidential campaign have been deflected to his Senate office, where staffers are lately telling his Arizona constituents that he is in favor of the pact. McCain had earlier told conservative bloggers that he was against it. Before that, he was in favor of the treaty. The confusion leads some to conclude that the only way to get a straight answer is to hire a lobbyist with special access to the candidate.
In the latest controversy, McCain’s campaign initially claimed that no representative of Paxson Communications or the lobbying firm Alcalde & Fay personally had asked Senator McCain to send a letter to the Federal Communications Commission (FCC) on behalf of Paxson, who had wanted approval to buy a television station. But Newsweek discovered that McCain himself, during a deposition, had admitted that “I was contacted by Mr. [Lowell] Paxson on this issue.” And Paxson tells the Post that he did have a meeting with McCain, although accounts differ on that.
McCain’s high-powered attorney, Bob Bennett, responded by telling the Post, “We understood that he [McCain] did not speak directly with him [Paxson]. Now it appears he did speak to him. What is the difference? McCain has never denied that Paxson asked for assistance from his office. It doesn’t seem relevant whether the request got to him through Paxson or the staff. His letters to the FCC concerning the matter urged the commission to make up its mind. He did not ask the FCC to approve or deny the application. It’s not that big a deal.” McCain was then the head of the Senate committee with jurisdiction over the FCC and its budget.
One of those defending McCain against the original story in the Times was John Feehery, who issued a statement declaring, “This kind of journalism only diminishes the reputation of the Times. I would expect this kind of reporting from the National Enquirer, not the New York Times.”
It turns out that Feehery is a lobbyist, too. A former top aide to former Speaker of the House Dennis Hastert, his firm, the Feehery Group, claims an “impressive list of Fortune 500 companies and trade associations, including Newscorp, Ford Motor Company, PHARMA, and the United States Chamber of Commerce, among its clients.” His website declares, “John Feehery’s extensive network of contacts on the Hill, on K Street and in the media rivals that of anybody else in Washington.”
It doesn’t help McCain to have lobbyists defending him against New York Times stories about his ties to lobbyists.
There was a Civil War general who had presidential hopes, and he always claimed he was born in the US, but he knew he was born on a boat in the middle of the Atlantic ocean. Nothing came of his presidential hopes (he was a lousy general).

The “naturalized citizen” bit is the biggest non-issue ever. By US law, if you are born to US citizens, anywhere in the world, you are a natural born citizen of the US. McCain’s parents were in the Canal Zone; his father was in the military (an admiral, IIRC). The Zone was then US territory, leased from Panama (lease ran out in ‘79, I think).
Put it this way – the inverse of “natural-born citizen” is “naturalized citizen.” Is McCain a “naturalized citizen?” Of course not.

The New York Times reports the circumstances surrounding McCain’s birth raise questions about his ability to become president since our founding fathers specifically said only a “natural-born citizen” can hold the highest office in the land. Turns out that the “chance meeting” of two 9-11 hijackers with an innocent Saudi in LA who then set them up with an apartment in San Diego is totally bogus.

Before the age of me having a cell phone, I had AT&T. During this time, we had a big emergency, and ended up making a lot of phone calls…totaling over 200 in a month. Mind you, nearly all calls I make are long distance anyway because of where I live. They shut our phone off in the middle of this not because we were late, but because they felt we had made too many phone calls. There were a lot of other things that happened, like getting sick of the every day phone calls for offers, but that was the last straw.
We shut off our phone after that and got cell phones.
Fast forward a number of years, and I decide to try to assist someone in getting a computer hooked up. I called AT&T, found out their not so fabulous high speed internet was going to cost nearly as much as cable, I tried to tell them no thanks, but they convinced me they’d give us a coupon for a free modem. They told me the coupon would come in 6 months. I said no, she said that she’d hold off on the modem charges and expedite the coupon so that it would be here before the charges came, and then we could redeem the coupon. I told her flat out that we would not be paying for that modem, and if we ended up paying it, we’d cancel service.
So guess what happened? Charges came and no coupon came.
During this, I’ve made 3 calls to At&t assuring us that the coupon would be here. And everytime, some high pressure sales to sell me something else, won’t let you hang up the phone till you finally have to just hang up.
So tomorrow I’m going to call them and cancel services again. We’ll switch him to cable. Why does this company continue to lose customers by the boatloads, and then can’t figure out why people won’t come back?

HEALTH CARE REFORM SEEMS STALLED
Two major parts of state health care reform appear to be in serious jeopardy and other proposals seem to be stalled. A proposed statewide smoking ban was bottled up in committee, and a 50-cent increase in the cigarette tax appears headed to the legislative bone yard. The two measures were promoted by the Kansas Health Policy Authority as key components of a package of 21 reform proposals. Gov. Sebelius said that the cigarette tax and the smoking ban would do more for health care costs in the future than any other two measures that we could pass, and those seem to be right now on life support at best. Senate Majority Leader Derek Schmidt, R-Independence, agreed. “I think the cigarette tax is (dead). The smoking ban is on life support and fading fast,”
Schmidt said.
The proposed tax increase would raise the state cigarette tax from
79 cents per pack to $1.29 per pack. Health officials have argued that the increase would help offset the damage caused by cigarette smoking in Kansas — 4,000 deaths and $930 million in health care costs each year.
The tax increase also would produce a stream of revenue for future expansion of health coverage.
The proposed smoking ban is having trouble getting out of committee with strong opposition coming from business owners across the state.
That bill would require a vote Nov. 4 in every county to determine whether to ban indoor smoking in restaurants and some other public places. Bars, casinos and tobacco shops would be exempt.

Testimony on immigration bills revealed to legislators that illegal immigrants fill between 2% and 4% of the jobs in Kansas, and some counties suffer from a labor shortage, state officials said Tuesday.
Many of those are jobs that American workers do not want, several business owners who rely on seasonal workers testified later in the day before the House Committee on Federal and State Affairs. Business owners urged legislators to push Congress to authorize more work visas so they could run their businesses and comply with the employment and immigration laws.
“No one wants to mow grass on a seasonal basis,” said Reg Robertson, who owns Custom Lawn and Landscape in Olathe. He said he struggles annually to fill 15 seasonal positions. This year, Robertson said he advertised in a newspaper and on the Kansas unemployment database and did not receive a single American applicant. Opponents of four House bills that crack down on immigration packed the committee room on the second day of testimony.
On the other hand, on Monday, legislators heard from supporters of the bills, including a Shawnee businessman who said his masonry company closed because it was unable to compete against contractors who used underpaid illegal workers.
The state Labor Department usually does not compile how many jobs illegal immigrants fill. It tried to develop a reliable estimate, though, because that question is frequently being asked these days, Department Secretary Jim Garner said. The labor estimate given to the Senate Committee on Federal and State Affairs on Tuesday was based on national averages and a study by the Pew Hispanic Center that estimates between 40,000 and 70,000 illegal immigrants live in Kansas. Rae Anne Davis, deputy secretary for the state Commerce Department’s workforce services division, told Senators that Kansas has a 4% unemployment rate, which is generally considered full employment. About one-quarter of the state, mostly western counties, have 3% unemployment and face a labor shortage for many types of jobs.
Conferees urged lawmakers to find a legal way to fill vacant positions with immigrants. Employers looking for seasonal workers can apply for what is called an H-2B visa, but there are too few visas available, they said. “I am very concerned about next year, when I expect to have great difficulty getting legal workers in a highly competitive visa environment,” said Bill Gordon, owner of Signature Landscape in Olathe.
Paul Kane, executive vice president of the Home Builders Association of Greater Tulsa, warned of unintended consequences. Oklahoma last year enacted strict illegal immigration rules. Since then, about 80% of home builders in the area have reported a loss of work force, he said, adding that many of those who left were legal immigrants who might have family members in the country illegally. Cities also cited concerns with requiring law enforcement to question people about their citizenship status. “Inevitably, it is going to end up with a discrimination lawsuit,” said Sandy Jacquot, director of law/general counsel for the League of Kansas Municipalities. Others questioned whether some of the problems the measures aim to solve — such as illegal immigrants voting or collecting public welfare — were really problems at all.
In the House, the four bills under consideration are HB 2370, 2680,
2836 and 2921. They focus on various aspects of illegal immigration, including use of E-Verify, making it illegal to rent to illegal immigrants and requiring law enforcement to ask everyone detained for a possible law violation about their citizenship or immigration status.
Rep. Arlen Siegfreid, R-Olathe, who chairs the House committee, said he planned to have lawmakers debate the bills and then probably combine them.
The Senate starts its own immigration hearings today in its Federal and State Affairs Committee with testimony from supporters of SB 458.
That bill would require businesses to use the federal E-Verify system to make sure new employees can work in the country.

Who should appoint judges?
SELECTION OF JUDGES
For half a century, Kansas Supreme Court justices have been picked by the governor from a list submitted by a nominating commission made up of lawyers chosen by a vote of the legal community and lay persons chosen by the Governor from each congressional district. When Kansas became a state, the constitution created a Supreme Court consisting of one chief justice and two associate justices elected from the state at large for six-year terms. Later, the court was expanded to its present seven members and a court of appeals was created to help handle the appellate cases.
In 1958, the people of Kansas passed a constitutional amendment to change the selection of justices from a partisan election to an appointment process. This change followed a political fast one that left Kansans very upset. Then Governor resigned after losing the gubernatorial primary and arranged for his immediate successor, the Lt.
Governor, to appoint him to the Supreme Court and for the Chief Justice of the court to retire. The infamous Triple Play of 1957 has been all but forgotten. Chief Justice William Smith resigned, Gov. Fred Hall resigned, and Lt. Gov. John McCuish replaced Hall — and within an hour appointed Hall to the court. All this occurred a few days before George Docking became governor.
Under the plan adopted in 1958 and still in existence today, there is an initial screening of candidates by the Supreme Court Nominating Commission. The commission nominates three persons for appointment by the governor. The governor makes the appointment and that justice stands for retention elections every six years. The Court of Appeals judges and about half of our district judges are selected the same way. Kansas uses two methods to choose its judges, either by merit selection with retention vote or by partisan elections. All 20 appellate justices and judges and 128 trial court judges in 17 judicial districts are chosen by merit selection. There are 115 trial court judges in the 14 judicial districts where judicial candidates run in political elections.
Now, Rep. Lance Kinzer wants to change the selection process for the nominating commission for the Court of Appeals and add Senate confirmation. This can be done by statute. Change of selection of the Supreme Court would require a constitutional amendment. A proposed constitutional amendment requires a two-thirds vote of the Legislature plus majority approval by voters. The Olathe Republican told the House Federal and State Affairs Committee last Thursday that attorneys hold too much sway with the current selection process.
Opponents of the Kinzer plan said the current system has worked since 1958 to keep partisan politics from the process. At issue is what’s called “merit selection,” where a nine-member Supreme Court Nominating Commission submits three nominees for a seat on the Supreme Court or Court of Appeals and the governor selects one from the list.
Kansas is among 22 states using merit selection, which started in Missouri in 1940. Of those, six require Senate confirmation, two mandate House and Senate approval and one calls for approval by an advisory council to the governor, according to the American Judicature Society.
Kinzer’s proposal takes selection of the nominating commission out of the hands of the state lawyers and the Governor and instead would have them all named by politicians: three named each by the governor, Senate president and House speaker, including at least one lawyer in each case. That would make all members of the commission beholding to a political sponsor. He also wants to take away the requirement that the governor pick from a list of nominees from the nominating commission and then require Senate confirmation for both Supreme Court justices and Court of Appeals judges.
Currently, the governor must chose from the nominees screened and selected by the nominating commission. Applicants are interviewed by the nominating commission, and then the finalist/nominees are interviewed by the governor and his/her staff. If the governor doesn’t make a selection within 60 days, the Supreme Court chief justice picks one of the nominees.
Even if Kinzer can muster the required 84 votes in the House, which is doubtful; his plan probably cannot pass the Senate, where it fell short of the two-thirds majority two years ago. At that time, many legislators were angry because the Supreme Court had upheld a district court decision on school finance. “I don’t expect the outcome to change. It’s not likely to get much traction this session,” said Senate Majority Leader Derek Schmidt. “We had that fight and lost.”
Kinzer, an attorney, does not like the commission having five lawyer and four non-lawyer members. He said his proposal would mean more diversity among commission members. “You get a broader group of life experiences if you take it away from the attorneys,” he said. “Maybe they don’t talk about politics, but they share a common outlook on life.”
Kinzer said federal judges undergo Senate confirmation, but opponents of his plan, including retired Justice Fred N. Six, noted federal judges are appointed for life. He said Kansas has a judicial system that’s independent and accountable to voters through periodic retention votes and called Kinzer’s proposal “a paper solution chasing a non-existing problem.”
Meanwhile, legislation has been passed by the Legislature that would help the public when appellate judges are up for retention. The Kansas Commission on Judicial Performance was created in 2006 by legislation inform the public about our judges and to improve the performance of individual judges and the judiciary as a whole. The Commission’s evaluations of all of the state court trial and appellate judges will be
provided to the judges and justices for self-improvement. In addition,
for judges and justices who are subject to retention elections, the Commission’s evaluations will be disseminated to the public to help voters make informed decisions about whether to continue those judges and justices in office.
The requirements for membership on the Commission on Judicial Performance? Members are appointed by the Judicial Council and are required to be persons of outstanding competence and reputation. Six of the Commission members are chosen from non-lawyers and six Commission members and the Chair are chosen from lawyers or judges. The statutes also require that at least two Commission members reside in each congressional district. None of its members are appointed by the Courts and no sitting judges or justices may serve on the Commission.
The Commission is required to publicly recommend that judges subject to retention elections either “be retained” or “not be retained.” To make this decision the Commission surveys persons who have appeared before or had professional contact with a judge or justice. That includes jurors, lawyers, witnesses, litigants, court workers, etc. The Commission has adopted performance standards upon which survey questions are based and has designed confidential surveys that ask those surveyed to evaluate the judge or justice on his or her ability, integrity, impartiality, communication skills, professionalism, temperament, and administrative capacity. In addition, the Commission is required to consider the judge’s or justice’s own self-evaluation. The Commission may also rely on any other information which assists in the evaluation of the judge or justice.
Because a key part of the Commission’s evaluation of judges and justices is the survey of persons who have appeared before or had professional contact with the judge or justice, information about the survey process may be of interest. As background, there are 263 judges and justices in Kansas. These 263 judges and justices can broadly be divided into two categories, appellate judges, of which there are 20, and trial court judges, of which there are 243. Appellate judges and justices can further be subdivided into two more groups, Supreme Court justices and Court of Appeals judges. Trial court judges can also be subdivided into two groups, district judges and district magistrate judges.
Supreme Court justices serve six-year terms and Court of Appeals judges serve four-year terms. The Commission has decided that, once the judicial performance program is fully implemented, surveys about all judges and justices will be conducted quarterly, with the quarterly results combined and used to generate final survey reports and midterm reports. Ideally, the number of completed questionnaires for each judge would be 400 collected over a four-year period. Twenty-five would be collected each quarter and a moving average would be maintained so that as 25 new surveys are added each quarter, the 25 oldest are deleted.
For trial judges, it would be ideal if half the sample were attorneys and half non-attorneys. For Supreme Court Justices the rolling average will be maintained over six years, the length of their terms.
Because of time and budget constraints, the target sample size for the first report will be reduced to 200. Not until after 2010 will the sample sizes be 400. Please note the use of the term “target sample size.” The sample size is a target because for many judges in sparsely populated counties or judicial districts it may not be possible to obtain a cumulative sample of 400 respondents even after attempting to survey everyone (not just a sample) who has observed the judge’s performance. In addition, a substantial portion of some judges’
dockets may be cases which are currently considered confidential and the names and addresses of those persons will not be available. Where the number of potential respondents is large enough, a random sample will be surveyed.
Does stalking include trolls?
STALKING LAW CHANGED
HB 2850 was up for debate today. The bill is a response to law enforcement officials testifying before the House Judiciary Committee that they are frustrated with the current stalking law. They believe the changes to the stalking law would help change that by allowing law enforcement and prosecutors to pursue a stalking case if a “reasonable”
person interprets actions as being threatening to them or their family.
A seemingly innocent gesture — a love note left on a door or a romantic song left on an answering machine — can terrorize a stalking victim under some circumstances and the stalker intends to create fear. Right now, police can do little to stop it.
Prosecuting attorneys and victims’ rights advocates testified that the words “credible threat” in the current law hamper efforts to stop stalkers. When applied to stalking, the term “credible threat”
generally has been defined as a threat made with the intent and apparent ability to carry out the threat, according to the U.S. Department of Justice. Courts have required that there must be a threat that would be recognized by a”‘reasonable person”. However, conferees pointed out how a love note that read, “I’ll love you till I die” written in blood by a former abuser or a romantic song that was played during a rape could be threatening to the victim, even though another person would not recognize it as a threat. Law enforcement and prosecutors told the committee that proving a credible threat often is an “insurmountable hurdle,” and that is the reason that few stalking offenders are charged with the crime.
An example presented in committee was the case of Jodi Sanderholm, 19, who was kidnapped, raped and murdered in January 2007. Stalking was at the root of that case, according to authorities, because the perpetrator had been stalking other women in town and other members of
Jodi’s dance team. 10 women testified at a hearing that Sonderholm’s
killer had harassed, abducted and stalked girls and women around Ark City since 2001.
Currently, a stalking conviction is a felony. The proposal would change the law to delineate three levels of the crime. A first-time conviction would be a Class A misdemeanor. Second and third convictions would be felonies with increasing levels of severity.
Kelley said.
In addition to living in fear, stalking victims also have to document what is going on while they are being stalked. Prosecutors need documentation of stalking behavior in order to bring the cases.
Stalkers aren’t awkward people lacking social skills, officials cautioned. Often they are cunning, manipulative and “hide behind a cloak of deniability.” Stalkers often know the current law and make sure their actions fall outside the latitude provided for proving a credible threat, said Cowley County District Attorney Chris Smith, speaking for the Kansas County & District Attorneys Association.

FEDERAL ECONOMIC STIMULUS PACKAGE TO AFFECT KANSAS REVENUE
Businesses looking to expand will get a bigger deduction on their federal income tax return because of a provision in the economic stimulus package approved this month by Congress. That is the same federal legislation that provides a $600 check to individual taxpayers later this year. Although it represents extra money for individual taxpayers, the stimulus legislation will mean an estimated $87 million loss in state income tax revenue this year and next from businesses.
A bill has been introduced that would “decouple” part of the state’s income tax code from provisions of the new federal law and allow the state to keep $84 million in the state treasury. That bill to eliminate a potential$84 million in state tax breaks for Kansas businesses in addition to the federal tax breaks they will receive is drawing strong opposition from House Republican leaders.
“We are not going to decouple from the federal tax policy,” House Majority Leader Ray Merrick, R-Stilwell, said during a legislative breakfast in Overland Park over the weekend. Merrick said the entire GOP House leadership opposes the bill.
Budget experts said the lost revenue may be offset somewhat by an estimated $25.6 million in new sales tax revenue from the money individual taxpayers will receive. That assumes they will spend half of the money on items that will yield sales tax revenue. Lost revenue from one tax source often results in a shift of the tax burden to other taxpayers.
Opponents of decoupling pointed out that, in 2010, the state will receive a corporate income tax bump of $21.9 million when the one-year stimulus package ends.

SENATE PASSES OVERHAUL OF TOURISM
The Senate today passed SB 501 which would transfer the state Division of Travel and Tourism to an independent agency. The bill creates the Kansas Tourism Corporation and transfers the division and its employees from the Department of Commerce. The Senate approved it 40-0. It now comes to the House. The corporation would have a 13-member board, with nine members named by the governor and legislative leaders. The Travel Industry Association of Kansas would appoint the other four.
I can see that Chas is all torn up over his Ex dying so he makes her a topic on this blog.

Now the name and address of Lori Drew and her family on Waterford Crystal Drive in St. Charles is out, even directions are being published, and The Los Angeles Times reports that dozens of concerned people have apparently been calling local businesses that work with the Drew family’s company, an advertising print shop.
The bloggers have exposed more than just the Drews’ home address; they have included phone numbers, email addresses and photographs that have also been posted on blogs such as RottenNeighbor.com and hitsusa.com.
Some sources report that people are driving through the once tranquil upscale neighborhood at night, screaming, “Murderer” at the residents of the house. The Drews, have now installed security cameras on the roof of their house.
Now mounting pressure has police cars patrolling Waterford Crystal Drive and prosecutors say they are trying to reopen the case.
