Would Rudy be undoing of Roe?

In a New York Times commentary, self-described “fervent pro-lifer” Eric Johnston makes an interesting argument that pro-choice, nonreligious Rudy Giuliani could be the means to a U.S. Supreme Court that will overturn Roe v. Wade: “Only a constitutionalist who supports abortion rights can create an anti-Roe majority by explaining that the end of Roe means letting the people decide, state by state, about abortion.”

    That is about the dumbest thing I ever heard. Roes is not going to be overturned. Even Supreme Court justices that don’t agree with earlier decsions almost always respect precedents that the nation has come to rely on. That is why they upheld the Miranda rule last year even though several justices disagreed with it. There is no way in hell that the court is going to cause the political and social unrest that would certainly follow a wholesale overturning of such a monumental landmark ruling. In fact, I almost wish they would try some crap like that. It would certainly hasten the demise of the Republican Party!

    I am not as confident that Roe would another conservative appointment to the S.Ct. But with the Democrats in control – and hopefully will remain in control after Nov 2008 – future S.Ct. appointments will have a more difficult time being confirmed in the Senate.

    Roe will not stand if another neocon judge gets put on the bench, Kev. It’s questionable if it would remain with the group we have now. Even those on the front lines of the choice movement know this. And we already have a plan in place IF that happens.

    I almost think sometimes we need to lose the rights we have and see the fallout once again. People born since Roe was ok’d don’t know what it was like before…they take it for granted that they’ll always have the freedom to choose. They haven’t lost a friend, they haven’t seen the bad things that will come.

    Roe is bad law.

    It will, eventually, be overturned.

    Doe V. Bolton is actually as big a problem as Roe V. Wade.

    They will BOTH be overturned.

    It might take awhile, but these laws/rulings do NOT meet the standard requirements for honoring “precendent.”

    They are NOT widely accepted.

    They do NOT meet modern needs. (There is no clear cut “trimester” demarkation, for instance.)

    Anyway, the radicals on both sides of this issue don’t really want Roe to go.

    Putting this issue BACK into the political process is the ONLY way it will ever go away.

    The radicals on the right want a Human Life Amendment with no exceptions. I should qualify that, the radicals on the right will be happy with nothing LESS than an Human Life Amendment.

    The radicals on the Left, who keep telling us that there is a “Pro-Choice Majority” will have to sell underage third-trimested taxpayer funded abortions without parental knowledge or consent.

    Tough sell, on both sides.

    Change is comming.

    This is true for the tally of votes THEY COUNTED. Not all actual votes were counted. The independent reports are speculations on what was probable, but not actually counted.

    You need not worry. While Roe may be chiped away at the fundamental right is going nowhere. It will never be overturned by any court. Not unless you get 5 Clarence Thomas’ which is not likely since most people know he is about the dumbest person to ever wear a robe (besides Klan members anyway).

    Roe will be overturned.

    That will NOT make abortion illegal.

    It will simply start the process of making abortion law more rational.
