Kansas Attorney General Paul Morrison suspected there would be problems with trying to test the constitutionality of the funeral picketing law by requiring him to file a lawsuit up front — a suspicion confirmed by the Kansas Supreme Court’s perplexed reaction to the lawsuit last month. “But the Legislature was adamant about trying to insulate the state from possible attorneys’ fees” should the Fred Phelps clan successfully challenge the law in court, Morrison told The Eagle editorial board this week.
Morrison is skeptical of such legislative triggers of attorney general action generally, mentioning lawmakers’ failed attempt to force his hand on the Tiller abortion case. “We think it’s a violation of the separation of powers, and that might very well be one of the things that the Supreme Court will look at.”
Even so, once the trigger question plays out, he thinks Kansas’ funeral law will hold up, like those in other states. The requirement that protesters stay 150 feet away from funerals “really isn’t very far back, as those laws go. We feel pretty comfortable that’ll stand.”

If killing, or not killing, is a requirement to get into heaven and the Bible is the rule book, why almost from page 1 to the last page is someone getting killed? If the Bible in fact says killing closes the door to heaven, then there might be a problem.
Considering that the Bible ends with the largest blood bath that will ever happen, and guess who is leading the charge, there must be more to this killing thing.
In other words, if the rule is “do not kill” and the rule book says this how you do it, something is wrong. At this point you either throw out the rule book and find out what it really says.

These lawsuits, like the one testing the recent Kansas gambling law, are they “real” suits, that is, filed by parties who have an actual stake in the outcome?

anon, an attempt to respond to your query in a way that hopefully makes sense.
These types of suits are really a request for an “advisory opinion”. Courts in the U.S., in the absence of some state constitutional or statutory provision, don’t issue advisory opinions. Federal courts never issue advisory opinions.
Under the teaching of Marbury v. Madison, there must be a real “case or controversy” for there to be an issue for the Courts to determine. To get around this, the Kansas legislature directed a case to be filed so the Kansas Supreme Court would (hopefully) hear it and issue its opinion prior to the law going into effect. The goal there was to avoid the potential of litigation against the State, which would result in the potential assessment of attorneys’ fees and damages against the state if the law was held unconstitutional. The court has signaled its reluctance to so do in the matter of the funeral picketing law, rightfully in my opinion.
While the state most definitely has an interest in the outcome, at present there is no “real party in interest” on the other side. The suit attempts to get around this by the legislature being named as a party, as I understand it. This is an artifice, as the Plaintiff here (the State? the Governor?) has nothing at stake, so to speak, in the suit.
Traditionally, when a Governor wants an opinion on a piece of legislation, s/he turns to the office of the Attorney General for the same. These AG opinions do not have the force of law or any precedential effect, as to the constitutionality of a law, while a Kansas Supreme Court decision does. Thus, the legislative attempt to force a decision.

So GOD comes to earth, and preaches something totally opposite of himself (or so say the ones who claim they’ve spoken to him). How do you, personally, rectify the two meldings- when the message is so incredibly different?

Vaughn Tolle – Thanks for the information. I did look at it. I noticed that it does not say that the Governor can direct the elected offices to do specific things. The Governors office can make a request just like the legislative branch can but I do not see where she can order them to do things.
