“Scooter” Libby and his backers may still think his sentence was unreasonable, but the vice president’s former chief of staff is unlikely to get any help from the high court, based on its ruling Thursday. The Supreme Court said that a sentence is considered reasonable if it falls within the federal sentencing guidelines — which Libby’s did. Interestingly, the case for the court was nearly identical to Libby’s. Victor Rita was sentenced to 33 months for perjury and making false statements; Libby got 30 months.

Well, sounds like pardon time is nigh. What’s the over/under on Bush granting the pardon within the next week? And will he do it in time for next Friday’s news dump?

“The prosecutor’s argument for a heavy sentence emphasized Mr. Libby’s alleged serious obstruction of justice–a complicated effort, considering that there was no underlying crime, or evidence thereof, and that this case, which had begun in alleged pursuit of the leak of a covert agent’s identity was, as the prosecutor himself would finally contend, not about that leak at all.
Just what serious obstruction of justice Mr. Libby could have been guilty of, then, was, at the least, a heady question, though not one, clearly, that raised any doubts in the judge. Neither did Mr. Fitzgerald’s charge–also in pursuit of a heavy sentence–that the defendant had caused, by his obstruction, no end of trouble and expense in government effort.
The obligation to truth, the prosecutor argued, was of the highest importance, and one in which Mr. Libby had failed by perjuring himself. It would be hard to dispute the first contention. It is no less hard to avoid the memory of Mr. Fitzgerald’s own dubious relation to truth and honesty–as, for example, in his failure to disclose that he had known all along the identity of the person who had leaked the Valerie Plame story. That person, he knew, was Richard Armitage, deputy to Colin Powell. Not only had he concealed this knowledge–in what was, supposedly all that time, a quest to discover the criminals responsible for the leak of a covert agent’s name–he had instructed both Mr. Armitage and his superior, Colin Powell, in whom Mr. Armitage had confided, not to reveal the truth.”
CF2K knows this one won’t last the night. But he doesn’t care. Here’s some first-day dialogue for Scooter after reporting to jail and meeting his new cellmate.

IP blocks are largely ineffective because most providers of DSL service use dynamic IP addressing schemes where they change subsciber IP numbers all the time to prevent subscibers from hosting. They only work when the person you are blocking uses a static IP address.

Libby lied to a grand jury. Why is so hard for the cons to understand that fact, I thought they were the law and order party. When you lie you pay the consequences like Martha and Bill did. Or is it only against the law when a Democrat lies under oath or obstructs justice?

Republican it was never about the truth as you pointed out. It was about pinning something on Cheney or Rove. When that failed they had to have someone to show for all the money they wasted. If it was really about the truth – why didn’t he go after Armitage in the first place. He knew the truth early on according to Novak who was directed to keep silent on that fact.
A pardon is past due and Fitz should be censured for using his position in an illegal way just as Nifong was.

First: the law is the law. Doesn’t matter whether the offense is (to use the apparent Wingnut distinction) “substantive” or a matter of “process.” Lawbreakers are to be punished. Period.
Second: there were multiple leaks at multiple levels. Multiple crimes appear to have been committed. We don’t know what deals were cut in response for what info. We’ll never know: Fitzgerald was a professional who ran a tight ship, unlike Kenneth Starr who leaked like a sieve, completely politicized his investigation, and wasted $70 million in Republican partisan witch hunt.
If Fitz had done what Starr did, you Repukes would be bitching and crying. Because he didn’t, you’re bitching and crying. The hell with you. You have zero intellectual integrity: all you’re about is winning.

Well, George Bush, at the recommendation of Peter Fitzgerald, the former Republican Senator from Illinois. So if you want to claim some “vast, Left-wing conspiracy” was behind “them” deciding to go after Rove and Cheney, it appears to be nothing more than a Right-wing projection onto Fitzgerald of something that frankly doesn’t exist. Patrick Fitzgerald was brought in as U.S. Attorney for Illinois after working as a career prosecutor in New York. Buzzflash describes his appointment this way:
“It may appear odd, but actually a maverick – although largely forgettable and ineffective – former Illinois Republican Senator, Peter Fitzgerald (unrelated to Patrick), is responsible for Fitzgerald’s appointment in Illinois. The former senator (who we will call Peter G. to avoid confusion) was at odds not only with Democrats but with the Republican Party in Illinois. He particularly squared off against then Republican Governor George Ryan (who is, ironically, now being tried for various felonies by Patrick Fitzgerald).
When it came time for the Bush White House to sign off on a new U.S. Attorney for Chicago, they, as is the custom, deferred to the senior Republican senator from Illinois. Usually, the position went to someone local – and it was thought that the U.S. Attorney in Chicago, in general, stayed out of investigations of politicians in either party, unless the crimes were so flagrant and public that they had no choice but to pursue prosecution.
So, Peter G. met with a bit of resistance, but ultimately prevailed. The White House apparently didn’t see any red flags and probably thought that they had a good mob prosecutor on their hands – little did they know that they were going to be one of the mobs that he was going to end up investigating. So, ultimately, Patrick Fitzgerald was appointed to his current Department of Justice post in Illinois by Bush. It is worth noting that whatever autonomy he has been granted, he still does ultimately report to the U.S. Attorney General: Bushevik crony Alberto Gonzales.”

What does have a basis in reality is that Fitzgerald was a straight arrow who refused to give a pass to those who appointed him. Fitzgerald’s investigation was hindered by what he knew and what he suspected, just as are ALL investigations. So he had a plan that he thought would land the biggest fish, which was likely Cheney (maybe Bush, who knows).
This, by the way, is what federal prosecutors and US attorneys DO. It’s why we have them around, to make plans to land big fish. Big fish who have harmed US citizens in the past and who if left unchecked may do more and greater harm in the future.
So he prepared his questioning and his grand jury presentation accordingly. Which is to say, he planned it so that those who failed to tell the truth were subject to punishment in order to provide incentive to truth-telling and thus achieve the greatest amount of punishment possible for those who could be reasonably judged by a jury of their peers to have broken the law.
Libby fell into Fitz’s trap. He lied. He committed perjury because he chose to lie when he’d given his oath that he would not. Perjury is illegal. It is harmful to our judicial system, which is of course harmful to our country as a whole. Libby will go to jail for it.
Anything else is just spin.

Just because Fitzgerald knew that Armitage revealed Plame’s identity–and stop LYING, ksgrm, because she WAS covert according to the CIA–doesn’t mean that others didn’t reveal it as well. Prosecutors follow where the trail leads, and if there was compelling evidence pointing further and elsewhere, Fitzgerald had a duty to follow.
“Why didn’t he go after Armitage?” Well, ksgrm, because Armitage admitted what he’d done, and because he was only a part of the picture of what was going on at the White House. David Corn writes
“Whether he had purposefully mentioned this information to Novak or had slipped up, Armitage got the ball rolling–and abetted a White House campaign under way to undermine Wilson. At the time, top White House aides–including Karl Rove and Scooter Libby–were trying to do in Wilson. And they saw his wife’s position at the CIA as a piece of ammunition. Two days after the leak appeared, I wrote:
Did senior Bush officials blow the cover of a US intelligence officer working covertly in a field of vital importance to national security–and break the law–in order to strike at a Bush administration critic and intimidate others?
And I stated,
Now there is evidence Bushies used classified information and put the nation’s counter-proliferation efforts at risk merely to settle a score.
The Armitage leak was not directly a part of the White House’s fierce anti-Wilson crusade. But as Hubris notes, it was, in a way, linked to the White House effort, for Amitage had been sent a key memo about Wilson’s trip that referred to his wife and her CIA connection, and this memo had been written, according to special counsel Patrick Fitzgerald, at the request of I. Lewis Scooter Libby, the vice president’s chief of staff. Libby had asked for the memo because he was looking to protect his boss from the mounting criticism that Bush and Cheney had misrepresented the WMD intelligence to garner public support for the invasion of Iraq.
The memo included information on Valerie Wilson’s role in a meeting at the CIA that led to her husband’s trip. This critical memo was–as Hubris discloses–based on notes that were not accurate. (You’re going to have to read the book for more on this.) But because of Libby’s request, a memo did circulate among State Department officials, including Armitage, that briefly mentioned Wilson’s wife.
Armitage’s role aside, the public record is without question: senior White House aides wanted to use Valerie Wilson’s CIA employment against her husband. Rove leaked the information to Cooper, and Libby confirmed Rove’s leak to Cooper. Libby also disclosed information on Wilson’s wife to New York Times reporter Judith Miller.”

This is the larger puzzle; that simultaneous activities to discredit Wilson and to expose Plame were proceeding on multiple fronts. The fact that Rove slipped through Fitzgerald’s dragnet means that Rove got lucky. Bully for him. But even on the face of it, there was lots more going on than just Richard Armitage, and Fitzgerald was hardly the “renegade” you and the other Wingnuts want to paint him as.

The legislation – the Financial Services and General Government Appropriations bill — will be considered on the floor of the House of Representatives next week.
“The Vice President has a choice to make. If he believes his legal case, his office has no business being funded as part of the executive branch. However, if he demands executive branch funding he cannot ignore executive branch rules. At the very least, the Vice President should be consistent. This amendment will ensure that the Vice President’s funding is consistent with his legal arguments. I have worked closely with my colleagues on this amendment and will continue to pursue this measure in the coming days.”

The last I knew, a prosecutor does not have any requirement to use ALL of the evidence he/she has in case.. The fact that ALL of the evidence was not used by Fitzgerald is not a crime… It is the choice of the prosecutor… The Defense could have used that information, because of the rules of Discovery… But, alas, they didnt use it either!!

As for the Right-wing editorial he posted trying to compare Fitzgerald with Nifong I would note a few MAJOR differences. Nifong methodically slimed the defendants at Duke; Fitzgerald simply methodically prosecuted Libby and WON A CONVICTION! A JURY CONVICTED LIBBY!
I don’t recall Fitzgerald calling Libby a ’slimey crook’ or a ‘hooligan’ or anything like that.

Pirates!The Simmons family made a visit to the set during the recent filming of “The Pirates Of The Caribbean – At World’s End”. This came at the invitation of their old friend, Lee Arenburg, who has a feature roll as Pintel in the pirate saga. Lee and his lovely girlfriend Katie gave us the royal treatment. We were introduced to Lee’s partner in the film Mackenzie Crook, who plays Ragetti, and Marty Klebba another unforgettable character. Such nice guys and so much talent. It was an amazing experience we will never forget. We’ve already seen the movie twice and loved it! Thanks Lee. Thanks to Cris Simmons (my wife) for taking the snapshot. Peace On EarthSeveral Doobie Brothers members, past and present, have contributed their efforts as part of a very special recording project with musical legend Willie Nelson.
Willie has written a song called “Whatever Happened To Peace On Earth”, and is donating all the proceeds of the song to a long time favorite Doobie Brothers charitable organization, the National Veterans Foundation. This project is a labor of love, with Willie inviting various friends and family members to join in.
Doobie Brothers Pat Simmons and Michael McDonald participated in the recording, playing and singing on the track. David Choy, who has played saxophone for the Doobies at various times, is also part of the project.

The Way They WereDo you ever wonder what musicians whose work you’ve come to know were doing before you ever heard of them? Well, here’s a chance to find out something about the Doobies’ own John McFee, and his former band mate Huey Lewis.
Sonic Past Music, a company that specializes in releasing just such products – for example, Richie Sambora’s pre-Bon Jovi work, or Randy Meisner’s non-Eagles material – has unearthed some “lost” recordings by the group Clover. As some of you may know, John and Huey, as well as “News” keyboard player Sean Hopper, were members of this group. On this set of recordings, you will also hear a young, pre-Toto Jeff Porcaro playing drums on several tracks. Additionally, the group features one Alex Call, who has written songs recorded by Pat Benatar, Huey, and others, including a huge hit for Tommy Tutone – “Jenny/867-5309″.
The recordings represented here were recorded at the famous Sound City Studios back in the early to mid seventies, with a number of the tracks produced by Keith Olsen – right around the time he produced Fleetwood Mac’s huge self-titled breakout album – the one with “Rhiannon”, “Over My Head”, “Say You Love Me”, and so forth.
Subsequent to these recordings, Clover went on to release two albums of their own that they recorded in Britain with producer Robert John “Mutt” Lange, and were Elvis Costello’s band for his award winning debut album My Aim Is True.

The Place To Be…It took place once again – this time around it was the 20th Annual B.R. Cohn Charity Fall Music Festival & Celebrity Golf Classic. Anybody who has attended one of these events knows what a wonderful time there was to be had, and all for worthy causes as well.
This year’s event, in particular the Music Festival, was perhaps even more special than ever, if we may say so without seeming immodest. First of all, the music festival covered two days, and second of all, check out what went down:
On October 7, the lineup included the Rowan Brothers, Pablo Cruise, Michael McDonald, Little Feat, and finally the Doobie Brothers WITH Michael McDonald. Wow.
On October 8, among the performers was none other than living legend, icon, singer/songwriter to end all singer/songwriters, and all around guru Willie Nelson. Not only that, guess who Willie’s band for this special show was … here’s a hint – the initials would be D.B.
So, as the title of this article suggests, this event was the place to be, for sure.

An Audience With The KingWhat an honor it was for several of the Doobie Brothers to get the opportunity to attend a performance by one of the greatest artists of all time, the one and only B.B. King.
Not only did the lucky Doobs get to hear this legendary blues man’s wonderful show, but Mr. King was incredibly gracious in extending an invitation to the boys to get together with him after the show for a visit.
If you’ve ever seen Mr. King perform or do an interview you have seen how intelligent, well spoken, and at the same time down to earth this man can be, and getting the chance to speak with him personally was illuminated by these very characteristics. This musical legend is a true gentleman, and for someone whose influence on popular music in general is practically boundless, his humble, honest, and friendly manner were truly refreshing in an era where hype powered egos abound.
Thank you B.B. King for everything you’ve given us through the years – your music, your wisdom, that amazing soul of yours – and thanks for the visit. You are the King!- The Doobies

Joe Cool – Magic JohnsonEvery now and then the guys in the Doobies actually have a chance to get out and hear some musical performances by artists that they admire. On a rare night off on the road just such an opportunity presented itself, in Dallas, Texas, when some of the members got a chance to attend the Joe Satriani / Eric Johnson concert at Grand Prairie’s Nokia Theatre.
It was a great night out, and we’d like to thank all of Joe’s and Eric’s people for being so gracious to the Doobies. There was no shortage of fine guitar playing and good music all ’round. These guys put on a great show, and the audience certainly enjoyed it – Doobies included.
Check out the picture accompanying this article, of Doobie Brother John McFee happily standing alongside one of his favorite guitarists in this or any other universe, Eric Johnson – Eric is truly a gifted player (and an excellent singer and composer as well, talents sometimes overlooked via “guitar hero” syndrome, as deserved as that accolade may be).

Good CompanySome people have all the luck – like those who happened to purchase tickets for one of the Doobies recent performances. Specifically, we’re talking about the second of two sold out shows at Vancouver’s River Rock Casino showroom. For that matter, the band members themselves feel incredibly fortunate to have had one of the greatest singers ever to hit the rock or any other scene join them onstage for a classic musical evening.
None other than Paul Rodgers, of Free, Bad Company, The Firm, and more recently Queen fame, came out with the lads to perform his classic “All Right Now”. We’re here to say that Paul, widely recognized as one of the finest and most influential vocalists in all of rock, is actually – and considering his history this is a truly amazing thing – singing better than ever, and that’s no jive.
Paul went on to blow everybody away with his soulful version of the classic blues rocker “Rock Me Baby”, and joined in on the finale “Listen To The Music”. Wow, wow, and more wow would be an understatement for how cool this night was!- Doobie Insider
Los DoobiesYou may already know Tex-Mex group Los Lonely Boys from their smash hit “Heaven.” On their upcoming release Órale! , they’ll have a new song featuring a little help from a Doobie Brother. That’s right, one of the new tracks, entitled “Roses” was co written by Pat Simmons!

Nifong is another one I’d like to see jailed … and found ‘pretty’ by his cellmates. In fact, put him in with others he went after.
I also suspect that Durham County has a rough road ahead as all of his prior prosecutions get questioned.
I personally don’t think people should be raped in jail, but that’s just me.
