It’s just what many people were worried about: Some of the abortion records obtained by former Attorney General Phill Kline may be missing. Attorney General Paul Morrison said he has most of the records. But he said that they had been "strung out to three or four different places that we know of." And he isn’t sure he has all the records, including those from patients at a Planned Parenthood clinic in Johnson County, where Kline is now the district attorney.

Mr. & Mrs. Big Mac….Here’s another chance.I kept my pie hole shut on the last one, just like I promised.
I can understand the need to provide the records to the special prosecutor, which have apparently been returned. I also understand the need to provide the Shawnee County DA with records, so that it might be determined by that official if a crime had been committed in the county for which prosecution would lie. I do not understand any records still being in the possession of the Judge who issued the initial subpoenas at this point; and, if true, I sure as the world do not understand why any records would have been forwarded to the Johnson County DA’s office before Mr. Kline officially took office, if the same had not been provided Mr. Morrison for review and action prior thereto.
I am ignorant of the Supreme Court’s order in this case, which, as I understand it, set conditions on the receipt and use of the records. If there are indeed “missing records”, I suspect this might be in violation of said order. Perhaps Mr. Kline has been so busy with setting up his new office he hasn’t had a chance to respond to Mr. Morrison’s contact; if so, surely he will do it post haste.
Well if Morrison doesn’t know if he has all the records why is he making a public comment?
I hope he doesn’t do this before a Judge when he’s making a case.

As I am not in the legal field, this may sound like a dumb question. Is there any certain procedure as to the transfer of such records. For example, if delivered by courier – is there a log stating which records are being transferred, to whom, what office and is anyone signing for these records once delivered?
I would think if there was some sort of paper trail, then finding these missing records would be just a matter of back-tracking?
Or will this end up to be one of those he said, she said kind of things?
Well, just another shining example of Phill Kline’s backhanded politics – I don’t suffer any doubt that there are probably several files missing. The same as I don’t suffer any doubt that Kline had no real charges to stand on, which is why he refused to let Foulston review the files on Tiller in the first place. Hopefully we are only talking about a few missing files and not a large number… THIS is exactly the reason why I did NOT support Kline having access to these files in the first place…

Yes, cs and everyone else wondering, a cautious attorney will get a receipt for any files, records, etc. transferred from his/her office to another, just to be able to provide the “chain of custody” in the event such is needed.
If there are files missing, do we know enough to know who is resposible for that? Is there a potential consequence for losing these files?
VT – and aren’t they numbered? I can’t recall what that stamp on the bottom of each sheet is called but I remember using it when taking notes from such documents. BATES or something like that?
Your recollection is correct, Ben. However, such is not always used in all cases, especially where the volume of paper is not voluminous.

In the cases I worked with, I had to sign my life away for records. Not that I know what attorneys do, just know from personal experience.
I was not allowed the original record and they slipped a sleeve of custody on my copy of the records along with a duplicate of where records had went in the Court or Courthouse files.
That was a different state in a different time though.
Rest assured though, if I did not return the copy of the records in the prescribed time, I would get a phone call from the Court or the Courthouse.

What a stupid statement for an Attorney General to make. If indeed the files are missing there is an established protocol to follow in order to recover them. I seriously doubt if asking the media to find them is among those. “Some” might be missing. If someone the libs liked made such a ridiculous statement the media would have been all over it. Morrison needs to work on his communication skills. Who knows he thinks some might be missing – he might just think he called Kline.

This will surely go back to the supreme court- as the files were given to him as Attorney General, not as the DA of JoCo.

1. What happened to the request or filing by the special prosecutor (whom Morrison fired)with the Kansas Supreme Court to reinstate the charges against Tiller? Is the case still pending?
2. Has there been a ruling by a higher court as to whether Kline had the power to file the charges? He said he explained the charges he intended to file, and said Foulston did not object. What would it take to get a court ruling on this issue?

I remember Nola Foulston clearly stating that Kline never did ask her about filing the charges. So what is the truth here?
Both sides canno be telling the truth. But I’m sure Kline knew perfectly well that Morrison would fire McKinney (the special prosecutor) when Kline hired him in the first place. So I see Kline’s action as purely political.
In as much as Kline firing so many people at the Johnson County DA’s office on his first day on that job. That was so obviously political that Kline has not made friends anywhere but his own OR group.
I just find it hard to believe that if Kline contacted Foulston’s office about filing those charges, then does he have any proof that he contacted her? Did he mail her the stuff and did not send it certified mail, return receipt requested? Did he send it by courier – then why didn’t he get a signed receipt when her office got them?
If he cannot provide proof of his contacting her, then it is a case of he said, she said. And this is the troubling part – surely Kline knew she would do this – so why did he not have his ducks in a row?

Knowing that the Governor asked Morrison, a Republican, to become a Democrat to run against Kline; knowing whose money paid for Morrison’s election; and that the Wichita Eagle is pro-abortion and therefore pro-Morrison and anti-Kline should tell any reasonable person what is going on.
From the governor on down, the support of Abortion is the key. This included pro-Morrison comments on this forum, i.e., they are from abortion supporters regardless of facts.

That said, these medical records are CONFIDENTIAL, and that means that only specified people are to have access to them. Kline is no longer one of those specified people. If he didn’t get his shit taken care of in time, that is not Morrison’s problem. Morrison has never said he wouldn’t file charges. In fact, he said he would IF THE SITUATION WARRANTED IT. However, he CANNOT determine if the situation warranted it if he doesn’t have the records to review that the court granted him. And no wonder he fired the special prosecutor. UNBIASED MY ASS. That was TOTALLY a political move on Kline’s part, appointing a Democrat who has demonstrated AGAINST abortion and has been vocal about it. So, since McKinney is a Democrat, Kline looks like he is trying to be non-partisan. But Morrison had to fire him, because he was obviously through his many affiliation with groups against abortion, not an unbiased party. It is likely that if Morrison finds grounds to file charges (which again, I am betting he won’t – especially since the best Kline could come up with was MISDEMEANORS) he will appoint a special prosecutor – one who doesn’t have an association with either pro-life or pro-choice groups…

Totally off topic but important. I took time out to feed the huge number of finches on our back deck. They haven’t been able to get to their normal food for days. Lots of birds don’t migrate and are in need of feed. Cardinals for example. One piece of advise I was given several years ago was not to take the dead plants out of our flower gardens in the fall. The birds use these gardens for shelter and also harvest the seeds from the dead heads. It is certainly true where we live. Enough said back to topic.

Wendy I did watch a 48 hours segment several years ago. They referred to abortion as a form of genocide because of the number of black babies being killed. If you play this back several years you would be taking girls in the childbearing age out of the mix and the result would be fewer black babies. So in a way this would create a smaller black population which could be why the gap is closing very quickly between the hispanic and black race. In my opinion.

In fact, it gets close to the truth only if you look at the percentage of white babies aborted vs. the percentage of black babies aborted.

PMom I train low income women with job skills necessary to reenter the work force. Then we make sure they have the necessary wardrobe to do this. I don’t just talk about it I do it as well as donating clothing, food and money to help those unable to help themselves. I just try not to brag like some people do. That wasn’t the way I was raised.

I’ve looked at the data and I see that 100% of people who get abortions are women. Clearly this is some genocidal act to eliminate all women off the planet. Something must be done about this atrocity, call all the male leaders of the anti-abortion groups to get their members together for a strategy meeting. With the combined forces of a few dozen people calling these women whores, sluts and murderers before they go into the clinic we should eliminate this problem.
Another great solution is to teach abstinence only education. Studies have shown that those who get abstinence only education are more likely to engage in oral and anal sex. We all know you can’t get pregnant taking it up the butt so that should cut down on abortions.
For those naysayers who say these methods don’t work I say you are just emboldening the abortionists. Never mind that the poor get more abortions because of lack of medical care access, that’s just defeatist talk. We must stay the course and not worry about non-Christian issues like taking care of the poor and universal health care. Preach on brothers (and sisters once you do your godly duty and produce three more children).

I don’t support the dissolution of all welfare but I do think that all able bodied persons on welfare should be working even if it is a make-work job.
My parents lived through the great depression and raised a family of 8 children without ever going on welfare. The village didn’t help them but their families and church did and my dad never set back and let someone else raise his children. I have a great admiration for him. He was a yellow dog democrat until the day he died. I often wonder what he would think of his party today.

Yes the end result is hopefully one that will help them move up the ranks. Once they are in the job thought they have to preform on their own, show up daily on time. This is one of the largest problem we have. Developing good work habits when you haven’t worked for year sometimes.

Within 90 days most new job placements have proved themselves – or not. They are then offered an increase in wages. There are some community college and technical classes that will talk with you about dress and will also have mock interviews in order to help you with the process.

KFG I’ll explain Roe V Wade to you. It is thought to be based on flawed thinking and has been in jeopardy several times. What it says is that the woman has the constitutional right to privacy under the Due Process Clause of the Fourteenth Amendment. I doesn’t address the right of the unborn baby and when there is a more conservative supreme court will probably be overturned. It will then become a state issue, with each state applying their own laws. In Kansas that would be the age at which an unborn baby is deemed viable. No where is the 14th ammendment is abortion listed. It must be one of those fill in the blank parts of the constitution as interrupted by liberal judges. Some of this is my opinion and some is based on facts which you can find on the Wikipedia website.
