Contrary to the statement released by his office Tuesday (which was still on his Web site as of Thursday evening), Attorney General Phill Kline does not think he won the case about mandatory reporting of underage sexual activity. “That was a mistake,” he told The Eagle editorial board. “It’s not a victory.” No kidding.
In fact, Kline contends that by allowing health professionals to exercise their judgment about when teen sex is injurious and should be reported, U.S. District Judge J. Thomas Marten’s order establishes a constitutional right to privacy that threatens other reporting laws. “The truth is Judge Marten’s decision went too far,” he said.
So does that mean that Kline is likely to appeal the decision? Yes, he said.
Great, more good tax money thrown after Kline’s bad opinion.

If Kline wants to preach his morals, he should start his own church. May he should just join the Phelps church.
Let me see if I can understand this. Kline is on a campaign to arrest teenagers for having sex. The BoE is preaching abstinence. Southwind is ranting against adult book stores and Terry Fox/Fred Phelps attack gays.
Man…sex is a hot topic for those who want to ‘protect’ us, isn’t it??
What a bonehead. He really is as dumb as he seems to be.
Can we recall this buffoon before he wastes any more tax dollars?
This clown fits the classic mold of seeing far more than he can possibly understand, i.e. , bewildered by his environment.
Kline needs to keep his personal opinions to himself, and quit trying to make them law!
Kline would be hilariously funny if it weren’t for the fact that he represents all of us in Kansas. I wonder how much the next phase of his silliness will cost the taxpayers.
So if the relations are consensual and there is no big age difference – what’s the crime?(I’m not so naive to think that all kids are gonna wait until 16.)I don’t get what the AG’s big problem is here – other than “big brother is watching you”.
Ten am and STILL no klein defenders here? Where oh where are the faithful?
Paul Morrison is going to crush this inDUHvidual like a roach hitting the windshield of a big rig.
He’s already history.
I notice that now that all of the work has been done in the Riverton school shooting plot Kline wants to take over the prosecution. I guess he figures that since someone else did everything he might be able to claim a victory.
Not unlike his performance at the BTK news conference Ben.
I repeat, the most dangerous place in the world is standing between phill klein and a tv camera.
The second most dangerous place?
Between klein and a print reporter.
The third most dangerous place?
Any place near Dr. Tiller.
I am feeling very hopeful about the race against Todd Tiahrt. I like what I am hearing and you all will soon see why.
The sad/disgusting thing is that there are a lot of people that think Kline is doing the right thing. The same people that are able to see evolution/creatism as black and white are the same people that see abortion as a black and white issue as well.
These people don’t want to think. They just want to be told what to regurgitate at the water cooler on Monday morning.
Hell, if they had to think it might distract them from this weekends NASCAR/Tractor Pull Combo Package…
heheh biz. almost ten am on saturday and STILL no klein defenders here. I think you are correct about people agreeing with them.
Wonder why they dont post here?
They feel more at home at Operation Rescue’s take on this. Proving that it is all a sham for the anti-abortion movement.
The main question here is – do we want to uphold the law or not? It is illegal for a child 14 years of age or younger to have sex. It is considered child abuse and should be reported.
Many times these young girls end up at abortion clinics and are taken there by the individual that got them pregnant. It goes unreported and the individual gets off scott free and sometimes he impregnates the young girl again and so the cycle continues. Where is the out cry for the young girl? She is now scared for life in more ways than one but all you see is your political views.
If you think that a 14 year old is mature enough and ready to be a parent think again. If you think a 14 year old is mature enough and ready to have an abortion think again. She is a child. She has no idea of what it means to be a parent.
Think about the girl and what kind of life she is going to have. It is our job as adults to protect her and help her to grow into a mature young lady. She is a victim and needs our help.
I do not know if the Attorney General went about this in the right way but we need to find a way to help these girls. They are victims.
AH, here is one.If it is, as you say, illegal for girls under 14 to have sex, why don’t we throw them in prison for having sex? Why do we only blame the boy, even if he is about the same age (which is what this court case is about)? Girls actually are more mature than boys of the same age, so why not blame them?
Many times the girl is taken to the birth center by the man who got her pregnant, too. Don’t we have to go after the birth centers and crisis pregnancy centers too?
A 14 year old who is pregant will have to have a baby or an abortion whether or not she is mature enough or we punish her boyfriend. Maybe we should worry more about how we delay maturity by believing in teenage, which wasn’t a social phenomenon before the boomers.
How does this opinion on this law help this situation in any way? Oh, it makes her less likely to go get birth control and prevent both because her doctor will have to report her hot 16 year old boyfriend who says he really loves her and he will probably break up with her. Sure, she will do it then.
Why is she a victim and her same aged boyfriend not? How is teaching women that they are inherently victimized going to teach them to be mature, self-respecting, and responsible adults? All it does is sell to stereotypes of women as blushing, weak virgins who need the state as their knight in shining armour.
For once I agree with you, Allie.Medical professionals are the best ones to determine what’s abuse and what’s immature, irresponsible, teenage behavior. Leave the state out of it. Law enforcement and the state should only get involved when the report is made by someone who knows how to assess abuse.
Aw, Damoon, I have agreed with you on several things. And, you have agreed with me on other things, just not on abortion. I think it would also be nice if the state and law inforcement were better at dealing with the actual cases of abuse (like all those non-sexual abuse cases) they receive.
Ruby,Professional ethical obligations carry more weight than legal ones. No doctor is going to harm his/her patient by having a policy of reporting underage sex.Consider the following exchange:14 year old patient: “Can you keep a secret?”Doctor: “I am required to report all instances of sexual activity under the age of 16″.Patient: “Oh. Nevermind.”
Compare it to this one:Patient: “Can you keep a secret?”Doctor: “I am required to report suspected abuse, but everything else is confidential”.
Suppose the patient wants to get on birth control. And she has chlamydia. How is encouraging her to keep her sex life a secret benefiting her?
Like I said before, no doctor will place a finicky legal opinion above the care of his/her patient. But it’s unfair to have a legal policy that possibly opens the door to the doc getting sued, fined or arrested(if the parents find the girl’s birth control, for instance).
Darwins? That would be good news! Do tell!
Kline has no interest in solving crimes or protecting young girls. That is unless they need to be protected from control over their own bodies.
This was an assault on pro choice nothing more. That and the ever present desire of some on the right to make all sex BAD! It is shameful that Kansans elected this clown. More is the shame that he has free access to public funds to pursue his personal agenda.
“The main question here is – do we want to uphold the law or not?”
If this is about upholding the law, why did he not solicit the BIRTH records as well.
As nathan likes to note, just because you say something doesnt make it true.
Why is ruby’s writing style so familiar? Similar to another multiple personality poster? I think this style has surfaced in several other posters’ writings. It is unique enough to be traced.
Bone dig time.
