When Kansas state senators recently voted to require that the Senate confirm the governor’s nominees to the Kansas Supreme Court, the proposed constitutional amendment went no further, thanks to House Judiciary Committee Chairman Mike O’Neal, R-Hutchinson. But his indifference may have ended with the court’s school-finance order. One among many bitter criticisms he’s offered since was this to The Topeka Capital-Journal: “The court cannot hold a gun to anybody’s head and say you’ve got to pass this bill.”

RE: Military Action Won’t End Insurgency (in Iraq), becomes totally apparent when you accept that we created the insurgency and civil war through our own military action into a country that did not attack or threaten us in any way. Once we admit this, we should release those we have put in camps, because their only crime has been to fight for their own country. We are the criminals,(in violation of the law) not the Iraqi’s and can’t charge them with any crime that would stick in the world court. The civil war we have triggered must be solved amongst themselves. Our presence only makes them hate us for being there and for what we have done to them. We went in on a false premise and remain there under false pretenses. Maybe we can regain some world honor by admitting our mistakes and getting the hell out.

It is unfortunate but all too frequent that the writer’s on the editorial board go off half cocked the fact is that the Kansas State Senate has yet to vote on the constitutional amendment the change the method of appointment of our appealant judges.

Sen. Journey is correct. I erred in saying the Senate had voted on the proposed constitutional amendment to give itself veto power over the governor’s nominees to the Kansas Supreme Court. It was not brought to a full Senate vote during the session. Had it been, however, it should have been a slam dunk, given that the legislation earned 28 sponsors in the 40-member Senate. I’m sorry I goofed, Senator, but my point holds: The school finance order ought to help this amendment’s prospects next year.
