For those of you awaiting Thomas Etheredge’s return to Wichita for the Village Charters preference trial in U.S. Bankruptcy Court, your wait is over.
Etheredge, listed as a witness in the case, will not be called to testify, his attorney Tom Gilman told me today. Nor will he enter any telephone or deposition testimony in the case. The case goes to trial Nov. 19 before Judge Robert Nugent.
To refresh: The issue is a $100,000 personal loan Village Charters owners Norman and Jeff Arensdorf made to Etheredge in January 2007 for the park. It’s one of several personal loans Etheredge sought to save the park as it plunged into what bankruptcy court records show as insolvency late in 2006.
The loan was repaid, but could be subject to recovery by the bankruptcy estate under preference laws.
